(Residential Facilities for the Handicapped) RECORDER'S OFFICE
AN ORDINANCE ENACTING SECTION 51-6-17, AND AMENDING
SECTION 51-13-1 OF THE REVISED ORDINANCES OF SALT LAKE CITY,UTAH,
1965, RELATING TO ZONING; PROVIDING FOR THE PROCEDURES FOR
PERMITTING RESIDENTIAL FACILITIES FOR HANDICAPPED PERSONS IN
ALL ZONES PERMITTING RESIDENTIAL DWELLINGS.
Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That Section 51-6-17 be enacted to read as follows:
Section 51-6-17. 1. A residential facility for eight (8) or fewer handicapped
persons shall, in accordance with this section, be permitted in any area where residential
dwellings are allowed. The facility shall comply with the following:
A. The facility shall conform to all applicable standards and
requirements of the Utah State Department of Social Services and be operated by or
under contract with the Department;
B. The facility shall comply with all Salt Lake City building, safety
and health ordinances for residential dwellings;
C. The handicapped residents of the facility shall be properly
supervised by the operator on a 24-hour basis;
D. 1) The operator of the facility shall establish a community
advisory committee through which all neighborhood complaints and concerns shall be
addressed;
2) The committee shall consist of at least the following
persons:
a) Two residents of the immediate neighborhood;
b) A representative of the Utah State Department of
Social Services; and
c) A representative of the Community Council;
3) The committee shall hear and arbitrate any complaints of
the neighborhood or the facility and shall make a recommendation to the board of
adjustment;
E. 1) The facility shall have off-street parking as follows:
a) One space for each staff person working during the
highest shift;
b) Two additional spaces if the facility has a house
family management arrangement;
c) One additional space for each vehicle used to
transport the handicapped residents;
2) All parking shall be located in an attached garage or in the
rear yard as set forth in Section 51-13-1(12),hereof;
F. The facility shall be capable of use for handicapped persons
without structural or landscaping alterations that would change the structure's residential
character.
G. The facility shall not be located closer than three-quarters of a mile
(3960 feet) of another residential facility for handicapped persons.
H. No person being treated for alcohol or drug abuse or who is violent
shall be placed in a facility.
I. Each handicapped resident of the facility shall reside in the facility
on a strictly voluntary basis and not as a part of, or in lieu of, confinement,rehabilitation,
or treatment in a correctional facility.
I Staff services shall be provided only to the residents of the facility.

2. An application for a group home for handicapped persons shall be
accompanied by a plot plan in duplicate, drawn to scale showing the actual dimensions of
the property, the size and locations of existing buildings, all hard-surfaced areas,
landscaped areas and such other information as may be necessary to provide for the
compliance of this section. An applicant shall submit a current listing, obtained from the
Utah State Department of Social Services, of the addresses of any other residential
facility approved and licensed in the City.
3. Upon compliance with the provisions of this section, the board of
adjustment shall issue a non-transferable Certificate of Occupancy. Such certificate shall
be renewed annually. The City shall, as a condition of such renewal, perform a safety
code inspection of the facility.
SECTION 2. That Section 51-13-1 be amended to add subsection (13) as
follows:
Section 51-13-1(13). A residential facility for eight (8) or fewer handicapped
persons, subject to the conditions set forth in Section 51-6-17 hereof.
SECTION 4. This ordinance shall take effect upon publication.
