053 of 2016 - Closing and vacating alleys adjacent to parcels located at approximately 211 ro 251 North Cornell St 0 16-1 P 16-23 SALT LAKE CITY ORDINANCE No. 53 of 2016 (Closing and vacating alleys adjacent to parcels located at approximately 211 to 251 North Cornell Street and closing an adjacent, unimproved portion of Seward Avenue) An ordinance closing and vacating alleys adjacent to parcels located at approximately 211 to 251 North Cornell Street pursuant to Petition No.PLNPCM2015-01002;and closing an adjacent,unimproved portion of Seward Avenue pursuant to Petition No.PLNPCM2016-00079. WHEREAS,the Salt Lake City Planning Commission held a public hearing on March 23, 2016 on an application submitted by Peter Corroon on behalf of Little Diamond Housing,LLC ("Applicant")to close and vacate alleys adjacent to property located at approximately 211 to 251 North Cornell Street and to close an adjacent,unimproved portion of Seward Avenue pursuant to Petition Nos.PLNPCM2015-01002,and PLNPCM2016-00079 in order to construct a transit- oriented,multifamily housing development;and WHEREAS,at its March 23,2016 meeting,the planning commission voted in favor of forwarding a positive recommendation to the Salt Lake City Council on said applications;and WHEREAS,after a public hearing on this matter the city council has determined that adopting this ordinance is in the city's best interests. NOW,THEREFORE,be it ordained by the City Council of Salt Lake City,Utah: SECTION 1. Closing and Vacating City-Owned,Unnamed Alleys. That the city- owned,unnamed alleys shown on Exhibit"A",which are the subject of Petition No. PLNPCM2015-01002,are hereby closed and vacated and declared not presently necessary or available for public use. SECTION 2. Closing an Unimproved Portion of Seward Avenue. That the portion of Seward Avenue shown on Exhibit"A",and which is the subject of Petition No.PLNPCM2016- 00079,is hereby closed as a public street and declared not presently necessary or available for public use. SECTION 3. Condition. The proposed street closure and alley vacations are conditioned upon the applicant satisfying the city's requirements for disposition of city-owned real property as set forth in Chapter 2.58(City Owned Real Property)of the Salt Lake City Code. SECTION 4. Effective Date. This Ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder. The city recorder is instructed not to publish or record this ordinance until the conditions identified above have been met as certified by the city's real property manager. SECTION 5. Time. If the conditions identified above have not been met within one year after adoption,this ordinance shall become null and void. The city council may,for good cause shown,by resolution,extend the time period for satisfying the conditions identified above.
