AN ORDINANCE CLOSING WINDSOR STREET AND WINDSOR STREET
RIGHT-OF-WAY FROM 800 SOUTH TO CHASE AVENUE, A PUBLIC STREET
AND RIGHT-OF-WAY IN SALT LAKE CITY, UTAH, SUBJECT TO CERTAIN
CONDITIONS.
WHEREAS, the City Council of Salt Lake City, Utah, finds, after public hearing,
that the City's interests in the public street and right-of-way described below are not
necessary for use by the public as streets or rights-of-way and that closure of the street
and right-of-way with the reservation of certain easements will not be adverse to the
general public's interest nor will it relinquish or terminate the City's interest in the
underlying property, without subsequent separate documents of transfer.
NOW, THEREFORE,be it ordained by the City Council of Salt Lake City,Utah:
SECTION 1. That Windsor Street, and a right-of-way continuing south from O
Windsor Street, from 800 South to Chase Avenue, which are the subjects of Petition No.
400-532-87 and which are more particularly described below, be, and the same hereby
are, CLOSED and declared to no longer be needed or available for use as a public right- o
of-way; and that title to the City's interest therein be reserved and retained by Salt Lake
City Corporation pending subsequent sale for market value and the completion of the
conditions set out below:
Windsor Street
Beginning at a point located on the south right of way line of 800 South Dx 7•a�'$7
Street 305 feet West of the Northeast corner of Block 2, Plat B, Salt Lake
City Survey, and running thence West 25 feet to the Northeast corner of
l Lot 5 of said Block 2, thence South 330 feet to the Southeast corner of Lot
4, thence East 25 feet to the Southwest corner of Lot 7, thence North 330
feet to the point of beginning.

Windsor Street Right-of-way
cl� Beginning at a point located at the Southwest corner of Lot 7, Block 2,
Plat B, Salt Lake City Survey and running thence West 25 feet to the
Northeast corner of Lot 3, thence South 165 feet to the Southeast corner of
Lot 3, thence East 25 feet along the South property line of Lot 8, said
�10,4 a point also being 305 feet West of the West right of way line of 900 East
Street, thence North 165 feet to the point of beginning.
SECTION 2. RESERVATIONS AND DISCLAIMERS. The above closures are
expressly made SUBJECT TO all existing rights-of-way and easements of all public
utilities of any kind and every description now located on and under or above the
confines of the above-described property and also SUBJECT TO the rights of entry
thereon for the purposes of maintaining, altering, repairing, removing or rerouting said
utilities,including the City's water and sewer facilities, and all of them. Said closures are
also SUBJECT TO any existing rights-of-way or easements of private third parties.
SECTION 3. CONDITIONS. Petitioner agrees that,in addition to paying the fair
market value for the closed street, petitioner will also construct, at its sole expense, a cul-
de-sac at the East end of Chase Avenue meeting all street design standards with all
required setbacks and landscaping which shall be dedicated to the City upon completion;
petitioner agrees to pay all costs associated with the street closure including the removal
or rerouting of utilities and the cul-de-sac construction; petitioner further agrees that no
service entrance or automobile access to petitioner's adjoining business will be provided 0
from the Chase Avenue cul-de-sac.
SECTION 4. EFFECTIVE DATE. This ordinance shall become effective on the
date of its first publication. The City Recorder is instructed to not publish the ordinance
until guarantees in a form approved by the City Attorney from the petitioner for _
completion of the conditions specified in Section 3 above have been received. If the
above conditions are not met within one (1) year, the time for their completion may be
extended by the Mayor for an additional one (1) year. If the conditions have not been
met within the maximum time, this ordinance shall become null and void and the City
Recorder is instructed not to publish it.
