WHEREAS, Petition No. 400-97-69 was filed with the City requesting the City to vacate a portion of the Kimball's Subdivision; and WHEREAS, one hundred percent of the owners of the property within and adjacent to the subdivision have not consented to the vacation; and WHEREAS, the City Council has reviewed the vacation which has been preliminarily approved by the Planning Commission on December 18, 1997, and February 19, 1998; and WHEREAS, good cause exists for the vacation of the portion of the subdivision and the City Council finds that neither the public nor any person will be materially injured by the proposed vacation; NOW, THEREFORE, BE IT ORDAINED by the City Council of Salt Lake City, Utah: SECTION 1. The City hereby approves the proposed vacation of a portion of the Kimball's Subdivision, as conditionally approved by the Planning Commission on December 18, 1997, and February 19, 1998. The portion of the subdivision to be vacated is more particularly described as set forth on Exhibit "A" attached hereto. SECTION 2. Conditions. This subdivision vacation is subject to the following conditions: 1. The new driveway access must be located in the same position as the existing street access and must line up with the existing mid -street landscape island on 800 West consistent with the requirements of the Division of Transportation. 2. All existing curb, gutter, sidewalk and sidewalk ramps that are defective must be replaced. 3. The abandoned railroad tracks that enter the site from 800 South must be removed and new street improvements must be installed on 800 South in its place. 4. Petitioner must meet all requirements and regulations of the Division of Transportation, Fire Department, Engineering Division, and Public Utilities Division as required by City ordinances. 5. 800 West may only be used by Petitioner's dairy trucks for six trips per day exiting the site. SECTION 3. Effective Date. This ordinance shall take effect upon the date of its first publication and shall be recorded with the Salt Lake County Recorder.
