054 of 2001 - closing a portion of Albermarle Avenue 0 01-1 P 01-10 CAPVt‘t (1101A51 SALT LAKE CITY ORDINANCE No. 54 of 2001 (Closing a Portion of Albermarle Avenue (1370 South) between 300 and 400 West) AN ORDINANCE CLOSING AN PORTION OF ALBERMARLE AVENUE (1370 SOUTH) BETWEEN 300 AND 400 WEST, PURSUANT TO PETITION NUMBER 400-01-03. WHEREAS, the City Council of Salt Lake City, Utah, finds after public hearings that the City's interest in the portion of the street described below, is not necessary for use by the public as a street and that closure of this portion of the street will not be adverse to the general public's interest; and WHEREAS, the title to the closed portion of the street shall remain with the City until sale for fair market value or the receipt of equivalent value in accordance with Salt Lake City Code, Chapter 2.58; NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That a portion of Albermarle Avenue (1370 South) located between 300 and 400 West, which is the subject of Petition number 400-01-03, and which is more particularly described on Exhibit "A" attached hereto, be and the same hereby is, closed and declared no longer needed or available for use as a street. SECTION 2. CONDITIONS. This street closure is conditioned upon the following: a. Existing public and private utility systems located within the area of the street closure must be properly disconnected or removed from the street area, in a manner which is acceptable to the entity who owns the utility system(s). b. The applicant must acquire all of the real property necessary to implement the redevelopment project conceptually proposed to the Salt Lake City Planning Commission. c. The applicant must make payment to the City of the fair market value of the closed portion of the street, or its equivalent, in accordance with Salt Lake City Code Chapter 2.58. d. The Chief Building Official of Salt Lake City must certify that the proposed redevelopment project has obtained all necessary City approvals so that the building permit for the redevelopment project is ready to be issued by the City. e. The applicant must submit a traffic impact analysis to the City, which must be approved by the City Transportation Director and the City Planning Director, as to: (a) the adequacy of the proposed ingress and egress to the site of the proposed redevelopment project; and (b) recommended or required transportation improvements on abutting public streets and plans to implement those improvements. f. Access to the Property located at 1388 South 300 West(Hafers 1388 Properties, L.C.) must be preserved on the closed street. g. Submission of a site plan that provides safe, clearly marked pedestrian circulation, appropriate landscaping and directional lighting throughout the project and the parking lot, to be approved by the City Planning Director. SECTION 3. EFFECTIVE DATE. This ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder. The City Recorder is instructed not to publish or record this ordinance until the conditions identified above have been met, as certified by the Salt Lake City Property Manager and the Director of the City's Community and Economic Development Department. SECTION 4. TIME. If the conditions identified above have not been met within one year after the adoption of this ordinance, this ordinance shall become null and void. The City 2 Council may, for good cause shown, by resolution, extend the time period for satisfying these conditions. Passed by the City Council of Salt Lake City, Utah, this 10thday of July 2001.
