(Closing a portion and vacating a portion
of an alley located between 200 East and 300
East and between Kelsey and Hampton Avenues,
pursuant to Petition No. 400-96-111)
AN ORDINANCE CLOSING A PORTION AND VACATING A PORTION
OF AN ALLEY, LOCATED BETWEEN 200 EAST AND 300 EAST AND
BETWEEN KELSEY AND HAMPTON AVENUE, PURSUANT TO PETITION NO.
400-96-111.
WHEREAS, the City Council of Salt Lake City, Utah,
finds after public hearing that the City's interest in the
portion of the alley described below is not necessary for
use by the public as an alley and that closure and/or
vacation of the portion of said alley will not be adverse to
the general public's interest; and
WHEREAS, the title to the closed portion of said alley
shall remain with the City until sale for fair market value;
NOW, THEREFORE, be it ordained by the City Council of
Salt Lake City, Utah:
SECTION 1. That a portion of an alley located between
200 East and 300 East and between Kelsey and Hampton
Avenues, which is the subject of Petition No. 400-96-111,
and which is more particularly described below, be, and the
same hereby is, closed and/or vacated and declared no longer
to be needed or available for use as an alley.
The portion of said alley to be closed is more
particularly described as follows:
Commencing at the southeast corner of Lot 73, of the
Jackson Square Subdivision, a subdivision of Block 21,
Five Acre Plat A, Big Field Survey, located in the
southwest quarter of Section 7, Township 1 South, Range
1 East, Salt Lake Base & Meridian; thence north 125
feet to a point on the east boundary line of Lot 73 of
said subdivision; thence north 45° east 7 feet to a
point on the north boundary line of said lot; thence
east 11.5 feet to the centerline of an alley running
north/south; thence south 130 feet along the centerline
of said alley; thence west 6.5 feet to the point of
beginning.
The portion of said alley to be vacated is more
particularly described as follows:
Commencing at the southwest corner of Lot 67, of the
Jackson Square Subdivision, a subdivision of Block 21,
Five Acre Plat A, Big Field Survey, located in the
southwest quarter of Section 7, Township 1 South, Range
1 East, Salt Lake Base & Meridian; thence north 130
feet to a point of the west boundary line of Lot 69 of
said subdivision; thence west 6.5 feet to the
centerline of an alley running north/south; thence
south 130 feet along the centerline of said alley;
thence east 6.5 feet to the point of beginning.

SECTION 2. .RESERVATIONS AND DISCLAIMERS. The above
closure and vacation is expressly made SUBJECT TO all
existing rights -of -way and easements of all public utilities
of any and every:description now located on and under or
over the confines of the property and also SUBJECT TO the
rights of entry thereon for the purposes of maintaining,
altering, repairing, removing or rerouting said utilities,
including the City's water and sewer facilities. Said
closure and vacation is also SUBJECT TO any existing rights -
of -way or easements of private third parties.
SECTION 3. TRANSFER OF TITLE. Title to the vacated
portion of this property is hereby transferred from the City
to all abutting property owners on a pro rata basis.
SECTION 4. EFFECTIVE DATE. This ordinance shall
become effective on the date of its first publication and
shall be recorded with the Salt Lake County Recorder.
