056 of 1992 - AN ORDINANCE ENACTING CHAPTER 15.14, SALT LAKE CITY CODE, RELATING TO FEES FOR THE USE OF THE CITY &0 92-1 0 92-2 SALT LAKE CITY ORDINANCE No. 56 of 1992 (City & County Building Use Fees) AN ORDINANCE ENACTING CHAPTER 15.14, SALT LAKE CITY CODE, RELATING TO FEES FOR THE USE OF THE CITY & COUNTY BUILDING. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That Chapter 15.14, Salt Lake City Code, be, and the same hereby is, enacted to read as follows: Chapter 15.14 Sections: 15.14.010 15.14.020 15.14.030 15.14.040 15.14.050 FEES FOR USE OF CITY & COUNTY BUILDING FACILITIES Definitions. Wedding, reception, meeting and filming fees. Reservations required. Hours of use. Restrictions on use. 15.14.010 Definitions. For the purpose of this chapter the following words shall have the meanings as given in this section. A. "Fee" means a non-refundable user charge for the use of space within the City & County Building. B. "Deposit" means a cleaning or damage deposit which shall be refundable if the facilities are left in a clean and undamaged condition. C. "Direct cost" means the City's actual cost, other than for cleaning or replacement or repair of damaged property, incurred as a result of the use of space within the City & County Building by a person, organization or group. Direct costs include but are not limited to room or building preparation or set up and special security, are payable in advance of use of the space, and are non-refundable once such costs are incurred. D. "Religious or charitable organization" means: any organization which provides to Salt Lake City written approval from the Internal Revenue Service that such organization has been granted tax exempt status under Section 501(c)(3) of the Internal Revenue Code, or its successor; or any organization which is organized for a civic, charitable or religious purpose and which is not engaged in business for economic profit. 15.14.020 Wedding, reception, meeting and filming fees. A. Except as may be provided under written agreement with Salt Lake City, any person, organization or group desiring to use the facilities within the City & County Building for wedding ceremonies and/or wedding receptions shall pay a fee for the use of such facilities according to the following schedule: 1. Wedding ceremony only (no food) (time limit of two hours), one hundred fifty dollars. A deposit of seventy- five dollars or fifty cents per person in attendance, whichever is greater, shall also be required. 2. Wedding reception only or wedding ceremony and reception (food involved), six hundred fifty dollars for the use of the facilities. A deposit of one hundred fifty 2 dollars plus fifty cents for each invitation sent or delivered, shall also be required. B. Except as may be provided under written agreement with Salt Lake City, any person, organization or group (other than a religious or charitable organization as defined in section 15.14.010 or its successor and other than a public entity) desiring to use the facilities of the City & County Building for meetings or activities other than weddings or wedding receptions or filming shall pay a fee for the use of such facilities according to the following schedule: 1. During regular business hours between eight o'clock a.m. and five o'clock p.m., Monday through Friday, twenty-five dollars per hour. A deposit of seventy-five dollars or fifty cents per person in attendance, whichever is greater, shall also be required. Meetings or activities during said business hours shall be limited to a maximum of forty persons and shall be for no more than three hours duration. 2. At any other time on weekdays except between eight o'clock a.m. and five o'clock p.m. and at any time on Saturdays, Sundays and holidays, twenty-five dollars per hour plus a single event charge of fifty cents for each person in attendance over fifty persons. A deposit of seventy-five dollars or fifty cents per person in attendance, whichever is greater, shall also be required. 3 C. Except as may be provided under written agreement with the City, any religious or charitable organization (other than a public entity and other than neighborhood civic organizations) desiring to use the facilities of the City & County Building for meetings or other activities, other than weddings, wedding receptions or filming, at times other than during regular business hours between eight o'clock a.m. and five o'clock p.m., Monday through Friday, shall be required to make a deposit of seventy-five dollars or fifty cents per person in attendance, whichever is greater. No fee for the use of the facilities shall be charged. During regular business hours between eight o'clock a.m. and five o'clock p.m., Monday through Friday, the maximum number of persons to be allowed in attendance at such meetings shall be forty persons unless a larger number can be accommodated without causing disturbance to governmental operations within the building and unless such larger number will be in compliance with all applicable building and fire codes. D. Except as may be provided under written agreement with Salt Lake City, any person, organization or group (other than a religious or charitable organization as defined in section 15.14.010 or its successor and other than a public entity and other than private parties doing filming for their own personal, non-commercial use) desiring to use the facilities of the City & County Building or the grounds of Washington Square for the purpose of making a film, whether motion picture or still, shall 4 pay fees and deposits for the use of such facilities according to the following schedule: 1. For filming which involves the following numbers of staff, crew or other persons at the filming site who are employed by or associated with the filming entity, a fee for each four hour block or portion thereof during which the city's facilities or grounds are being used, plus a one-time deposit for the event, as follows: Fewer than eight persons: $250.00 fee per four hours plus a $500.00 deposit Eight to fifteen persons: $500.00 fee per four hours plus a $750.00 deposit More than fifteen persons: $1,000.00 fee per four hours plus a $1500.00 deposit 2. For filming by a religious or charitable organization as defined at Section 15.14.040 or its successor or by a public entity no fee shall be charged, but a one-time deposit for the event shall be required according to the number of staff, crew and other persons at the filming site who are employed by or associated with the filming entity as follows: Fewer than eight persons: A $500.00 deposit Eight to fifteen persons: A $750.00 deposit More than fifteen persons: A $1500.00 deposit E. 1. Whenever a deposit is required under this chapter, any expense incurred by Salt Lake City as a result of the 5 use by a person, organization or group shall be deducted from such deposit, and the balance shall be refunded to the user. 2. In the event cleaning or property damage expenses incurred by the City resulting from the use of the city facilities exceed the amount of any deposit required hereunder, the person, organization or group which reserved the use of the facilities shall be liable to Salt Lake City for such expenses in excess of the deposit. A reasonable deposit in a sum greater than that set forth herein may be required by the City of any person, organization or group whose previous use of City facilities has resulted in expenses to the City in excess of the required deposit. 3. The City may refuse the use of City facilities to any person, organization or group (a) whose previous use of said facilities has resulted in expenses to the City in excess of a required deposit; or (b) which has failed or refused to pay the City for expenses to the City previously incurred in excess of a required deposit or (c) whose prior use of City facilities resulted in a violation of a Salt Lake City ordinance or state or federal law. F. In addition to any fees and/or deposits which may be payable under any provision of this chapter, all direct costs as defined in section 15.14.010 or its successor reasonably anticipated by the manager of the City's Support Services Division or his/her successor shall be payable to the City in 6 advance of the use of said City facilities by any private person, organization or group, or by any religious or charitable organization or public entity. 15.14.030 Reservations required. Any use of the City & County Building by any private person, organization or group or by any public entity other than Salt Lake City Corporation or by any religious or charitable organization shall be coordinated through the manager of Salt Lake City's Support Services Division or the successor to that position. Whenever there is a conflict between an event scheduled to be held in the City Council chambers and a regularly scheduled meeting of the City Council, the needs of the City Council shall take precedence. 15.14.040. Hours of use. No weddings, receptions, meetings or other events shall be held within the City and County Building between the hours of twelve o'clock midnight and six o'clock a.m. of any day. All such events scheduled to begin prior to twelve o'clock midnight of any day shall conclude no later than twelve o'clock midnight of the day so scheduled. 15.14.050. Restrictions on use. Regardless of any other provision of this chapter, the facilities within the City & County Building shall not be used at any time for school proms or dances. Prior to approval of any request by a religious organization for use of said facilities, such request shall be reviewed by the City Attorney or his/her 7 designee to ascertain whether such use would be in violation of the First Amendment to the Constitution of the United States or of Article I, Section 4 of the Constitution of Utah. SECTION 2. EFFECTIVE DATE. This ordinance shall take effect upon the date of its first publication.
