Andrew Avenue and Van Buren Avenue and between
400 West and 300 West, pursuant to
Petition No. 400-97-02)
AN ORDINANCE CLOSING A PORTION OF AN ALLEY LOCATED BETWEEN
ANDREW AVENUE AND VAN BUREN AVENUE AND BETWEEN 400 WEST AND 300
WEST, PURSUANT TO PETITION NO. 400-97-02.
WHEREAS, the City Council of Salt Lake City, Utah, finds
after public hearing that the City's interest in the portion of
the alley described below is not necessary for use by the public
as an alley and that closure of said alley will not be adverse to
the general public's interest; and
WHEREAS, the title to the closed portion of said alley shall
remain with the City until sale for fair market value;
NOW, THEREFORE, be it ordained by the City Council of Salt
Lake City, Utah:

SECTION 1. That a portion of an alley located between Andrew
Avenue and Van Buren Avenue and between 400 West and 300 West,
which is the subject of Petition No. 400-97-024, and which is
more particularly described below, be, and the same hereby is,
closed and declared no longer be needed or available for use as
an alley.
Commencing at a point that is west 38.5 feet from the
southeast corner of Lot 34, of the Stewart's Addition, a
subdivision of Block 9, Five Acre Plat A, Big Field Survey,
located in the northwest quarter of Section 13, Township 1
South, Range 1 West, Salt Lake Base & Meridian; thence north
46.2 feet; thence west 250 feet more or less to a point
where the railroad right-of-way intersects with the south
boundary line of Lot 24 of said subdivision; thence
southwesterly 20 feet more or less along a railroad right-
of-way to a point 10.5 feet west from the northeast corner
of Lot 12 of said subdivision; thence east 260.5 feet to the
northeast corner of Lot 2 of said subdivision; thence south
46.2 feet to the northwest corner of Lot 1 of said
subdivision; thence east 16.5 feet to a point on the north
boundary line of said lot; thence north 16.5 feet to the
point of beginning.
SECTION 2. Reservations and Disclaimers. The above closure
is expressly made subject to all existing rights of way and
easements of all public utilities of any and every description
now located on and under or over the confines of the property and
also subject to the rights of entry thereon for the purposes of
maintaining, altering, repairing, removing or rerouting said
utilities, including the City's water and sewer facilities. Said

closure is also subject to any existing rights of way or
easements of private third parties.
SECTION 3. Transfer of Title. The title to this closed
portion of said alley shall remain with City until sale for fair
market value.
SECTION 4. Effective Date. This ordinance shall become
effective on the date of its first publication and shall be
recorded with the Salt Lake County Recorder.
Passed by the City Council of Salt Lake City, Utah this 9th
day of September , 1997.
