(Theatres and Concerts)
AN ORDINANCE AMENDING CHAPTER 20 OF TITLE 20 OF THE REVISED
ORDINANCES OF SALT LAKE CITY, UTAH, 1965, RELATING TO THEATRES
AND CONCERTS BY ADDING NEW SECTIONS 22, 23, 24 AND 25.
Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That Chapter 20 of Title 20 of the Revised
Ordinances of Salt Lake City, Utah, 1965, relating to theatres
and concerts, be, and the same hereby is amended by ADDING new
Sections 22, 23, 24 and 25 to read as follows:
Sec. 20-20-22. Seating of patrons. (1) General admission
seating wherein persons are admitted without being assigned a
particular reserved seat is hereby prohibited in all theatres,
arenas, concert halls and other places of assembly when the
seating capacity of the facility is 2,000 or more; provided,
however, that this section shall not apply to: (a) high school
and college athletic events, (b) religious events sponsored by
bona fide religious organizations; or (c) events where the
sponsor has applied for and received specific exemption from Salt
Lake City Corporation.
(2) Exceptions. In determining whether the event shall be
exempt from the prohibition against general admission or seating,
the Mayor or his designated agent shall consider the following
factors: (a) the facility where the event is scheduled; (b)
the size, age and anticipated conduct of the crowd; (c) the
ability of the applicant to manage and control the expected
crowd; and (d) the potential hazards to the health, safety and
welfare of the participants, spectators, and the community
associated with this particular event. Applications for
exemption shall be filed with the Mayor at least thirty days
prior to the date of the event.
Sec. 20-20-23. Selling of tickets exceeding capacity places
of assembly. It shall be unlawful to sell, give or in any other
way disseminate tickets to any theatre, arena, concert hall or
other place of assembly, in a number exceeding the maximum
capacity of said location, as determined under the provisions of
Title 15 of Salt Lake City Corporation's ordinances entitled
Life/Fire Safety Code.
Sec. 20-20-24. Admittance Procedures Notice. At all
theatres, arenas, concert halls and all other places of assembly
required to be licensed under this chapter, when the seating
capacity of the facility is 2,000 or more or when the anticipated
crowd is 3,000 or more, the sponsor of the event shall publicize
at least 48 hours prior to the event the time when patrons may be
admitted to enter the facility. In addition, the sponsors shall
open the doors for public admittance at least two hours ahead of
the scheduled opening, to avoid risk of substantial danger or
injury to persons or property.
Sec. 20-20-25. Crowd Control. For crowd control purposes,
the police and/or fire department officials shall have authority
to order the placement or removal of barriers, the opening or
closing of doors or other entrances or exists, the establishment
of check points or other crowd control measures whenever the
size, nature or conduct of the crowd, (in light of all other
facts and circumstances at the time, including the number of
personnel on the scene to control or accommodate the crowd)
indicates that there may exist a risk of danger or injury to
persons or property. Nothing in this section shall be construed
in any way to lessen in any manner the liability of those
responsible for the management and operation of the event,
including the employment of adequate personnel for security,
safety, health and sanitation or to limit the other power or
authority of the police, fire or other officials of the City.
SECTION 2. This ordinance shall take effect 30 days after
its first publication.
