SALT LAKE CITY ORDINANCE

(Amending the Salt Lake City Code regarding
the use policy and restrictions for
City -owned motor vehicles.)
AN ORDINANCE AMENDING CHAPTER 2.54.030 OF THE SALT LAKE
CITY CODE REGARDING THE USE POLICY AND RESTRICTIONS FOR
CITY -OWNED MOTOR VEHICLES.
WHEREAS, the Salt Lake City Code contains certain
restrictions on the use of City -owned motor vehicles for
driving to and from an employee's home; and
WHEREAS, the City Council has determined that existing
City ordinances should be modified to allow City -owned motor
vehicles to be taken home under appropriate circumstances
that would provide a benefit to the City as a whole; and
WHEREAS, the City Council has determined that the
current basis for determining the appropriate costs to be
paid by employees using City -owned motor vehicles for take
home use should be revised to more actively reflect City
policies and priorities;
NOW, THEREFORE, be it ordained by the City Council of
Salt Lake City, Utah:
SECTION 1. That Chapter 2.54.030 of the Salt Lake City
Code shall be and hereby is amended to read as follows:
2.54.030 Use Policy and Restrictions:
A. No motor vehicle owned by the City may be
taken home by any City employee except under the
following circumstances:
1. Written permission is granted by the mayor
or the mayor's designee on a demonstrated need
for such vehicle to be taken home to serve the
public interest. Such demonstrated need shall
be deemed to exist for the following employees:
(a) Department heads;
(b) Employees who are subject to twenty-
four -hour call;
(c) Employees who submit written
verification that they drive at least an
average of four hundred miles per month
on city business, other than during
regular city duty time; or
(d) Employees who demonstrate that they are
subject to frequent call-backs to work
on off -duty time.
2. An employee may take home a City -owned
vehicle when an isolated incident of use,
because of the lateness of the hour or other
peculiar circumstances, makes it impractical or
impossible to return such vehicle to city
custody at the end of a duty shift.
B. Employees who wish to use City -owned motor
vehicles on a voluntary basis to travel to and
from their homes may do so only with the knowledge
and consent of the appropriate department head,
and only if such employees make payment to the
City for such use according to a written fee
schedule adopted by the mayor or mayor's designee.
Such fee schedule may include a policy favoring
those employees who live within the City. The fee
required shall be no greater than the total actual
costs incurred by the City from such voluntary
use, including depreciation and capital costs.

C. Except as set forth above, under no
circumstances shall a city vehicle be used for any
purpose other than city business, to promote a
city interest, or for any use other than
authorized by the mayor or the mayor's designee.
SECTION 2. Effective Date. This ordinance shall become
effective on July 1, 1999.
