No. 59 of 2002
(Amending the Salt Lake City Code regarding
obstructions in required yard areas)
AN ORDINANCE AMENDING THE SALT LAKE CITY CODE REGARDING
OBSTRUCTIONS IN REQUIRED YARD AREAS, PURSUANT TO PETITION NO. 400-01-
26,
WHEREAS, the Salt Lake City Code contains regulations regarding the required front,
side and rear yard areas; and
WHEREAS, the City Code also contains regulations regarding what items may or may
not be located in those required yard areas; and
WHEREAS, after further reviewing this matter, the City Council has determined that the
amendments to the City Code set forth herein are in the best interests of the City.
NOW, THEREFORE,be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. The table entitled"Obstructions in required yards" located at Section
21A.36.020.B of the Salt Lake City Code, shall be and hereby is amended to read as set forth on
Exhibit"A" attached hereto.
SECTION 2. Section 21A.52.030.R of the Salt Lake City Code shall be and hereby are
amended to read as follows:
R. Front yard parking(subsection 21A.44.050A of this Title);
SECTION 3. Sections 21A.52.030.T and U of the Salt Lake City Code shall be and
hereby are enacted to read as follows:
T. Window mounted refrigerated air-conditioners and evaporative "swamp"
coolers located less than 2 feet from a lot line. (Table 21A.36.020B
Obstructions in Required Yards) (Section 21A.52.100 H); and
U. Ground mounted central air conditioning compressors or systems, heating,
ventilating, pool and filtering equipment located less than 4 feet from a lot
line. (Table 21A.36.020B Obstructions in Required Yards) (Section
21A.52.100 I).
SECTION 4. Sections 21A.52.100.H and I of the Salt Lake City Code shall be and
hereby are enacted to read as follows:
H. Window Mounted Refrigerated Air-Conditioners and Evaporative Swamp
Coolers Located Within 2 Feet of the Property Line: Window mounted
refrigerated air-conditioners and evaporative swamp coolers located closer
than 2 feet from the lot line must comply with applicable Salt Lake
County Health Department noise standards.
I. Ground Mounted Central Air-Conditioning Compressors or Systems,
Heating, Ventilating, Pool and Filtering Equipment Located Within 4 Feet
of the Property Line: Ground Mounted Central Air-Conditioning
Compressors or Systems, Heating, Ventilating, Pool and Filtering
Equipment in the Side Yard located closer than 4 feet from the lot line
must comply with applicable Salt Lake County Health Department noise
standards.
SECTION 5. Legislative intent and recommendation. In enacting this ordinance, it is
the intention and recommendation of the City Council that the special exceptions authorized
herein for air conditioning units be designated as routine and uncontested matters by the Salt
Lake City Board of Adjustment, pursuant to the provisions of Salt Lake City Code Chapter
21A.14.
SECTION 6. Effective Date. This ordinance shall become effective on the date of its
first publication.
