SALT LAKE CITY ORDINANCE
No. 59 of 2015
(Amending the zoning map pertaining to property located at 563 East 600 South Street
and 567 East 600 South Street to re-zone the 563 East parcel from
RMF-35(Residential Multi-Family)to R-MU-35(Residential/Mixed Use)and the 567 East
parcel from CN(Neighborhood Commercial)to R-MU-35(Residential/Mixed Use),and
amending the Central Community Master Plan Future Land Use Map for the 563 East parcel)
An ordinance Amending the zoning map pertaining to property located at 563 East 600
South Street and 567 East 600 South Street to re-zone the 563 East parcel from RMF-35
(Residential Multi-Family)to R-MU-35(Residential/Mixed Use)and the 567 East parcel from
CN(Neighborhood Commercial)to R-MU-35(Residential/Mixed Use),and amending the
Central Community Master Plan Future Land Use Map for the 563 East parcel pursuant to
Petition Nos.PLNPCM2014-00832 and PLNPCM2014-00833.
WHEREAS,the Salt Lake City Planning Commission held a public hearing on February
25,2015 on an application submitted by Kristen Clifford,representing the property owner,
Ernesto Gutierrez("Applicant")to amend the city's zoning map to re-zone property located at
563 East 600 South Street from RMF-35(Residential Multi-Family)to R-MU-35
(Residential/Mixed Use),to re-zone property located at 567 East 600 South Street from CN
(Neighborhood Commercial)to R-MU-35(Residential/Mixed Use),and to amend the Central
Community Master Plan Future Land Use Map concerning the property located at 563 East 600
South Street to change the future land use designation of that property from Medium Density
Residential to Medium Density Residential/Mixed Use pursuant to Petition Nos.PLNPCM2014-
00832 and PLNPCM2014-0833;and
WHEREAS,at its February 25,2015 meeting,the planning commission voted in favor of
forwarding a positive recommendation to the Salt Lake City Council on said applications;and
WHEREAS,after a public hearing on this matter the city council has determined that
adopting this ordinance is in the city's best interests.
NOW,THEREFORE,be it ordained by the City Council of Salt Lake City,Utah:
SECTION 1. Amending the Zoning Map. The Salt Lake City zoning map,as adopted
by the Salt Lake City Code,relating to the fixing of boundaries and zoning districts,shall be and
hereby is amended as follows,subject to the conditions set forth in Section 3 herein:
a. That the property located at 563 East 600 South Street(Tax ID No.16-06-477-
023),and more particularly described on Exhibit"A"attached hereto,shall be and hereby is re-
zoned from RMF-35(Residential Multi-Family)to R-MU-35(Residential/Mixed Use);and
b. That the property located at 567 East 600 South Street(Tax ID No.16-06-477-
026),and more particularly described on Exhibit"B"attached hereto shall be and hereby is re-
zoned from CN(Neighborhood Commercial)to R-MU-35(Residential/Mixed Use).
SECTION 2. Amending the Central Community Master Plan. That the Future Land
Use Map of the Central Community Master Plan shall be and hereby is amended to change the
future land use designation of the property located at 563 East 600 South Street from Medium
Density Residential to Medium Density Residential/Mixed Use.
SECTION 3. Approval of the amendments described in Sections 1 and 2 above are
conditioned upon Applicant entering into a development agreement with the city that requires:
a) That no building constructed on either the 563 East or 567 East 600 South Street
properties shall exceed thirty-five feet(35')in height;and
b) The petitioner shall prepare the development agreement in a form that is satisfactory to
the City Attorney.
Such development agreement shall be executed by the Applicant and by the mayor or
they mayor's designee. The executed development agreement shall be recorded against the
Property by filing an original thereof with the Salt Lake County Recorder.
SECTION 4. Effective Date. This ordinance shall become effective on the date of its
first publication. The city recorder is instructed to not publish or record this ordinance until the
conditions identified above have been met,as certified by the city's planning director.
SECTION 5.Time. If the conditions set forth herein are not satisfied within one year
from the adoption of this ordinance,it shall become null and void. The city council,may for
good cause shown,extend the deadline provided herein up to one additional year by resolution.
