AN ORDINANCE AMENDING TITLE 25 OF THE REVISED ORDINANCES OF
SALT LAKE CITY, UTAH, 1965, BY ADDING A NEW CHAPTER 30, RELATING
TO ESTABLISHMENT OF THE COMMUNITY DEVELOPMENT ADVISORY COMMITTEE.
Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That Title 25 of the Revised Ordinances of Salt
Lake City, Utah, 1965, be, and the same hereby is, amended by
adding a new Chapter 30, relating to establishment of the
Community Development Advisory Committee, as follows :

Sec . 25-30-1 . Definitions. For the purpose of this chapter
the following words shall have the meaning as given herein :
( 1) "Committee" means the Salt Lake City Community
Development Advisory Committee created under this ordinance .
(2 ) "Council" means the Salt Lake City Council .
(3) "City" shall mean and have reference to Salt Lake City
Corporation, a municipal corporation of the State of Utah.
(4 ) "Mayor" means the duly elected or appointed and
qualified Mayor of City.
( 5 ) "Member" means a person appointed by the Mayor who is
duly qualified and acting as a member of the Committee .
(6 ) "Person" means an individual .
Sec . 25-30-2. Creation of Committee. There is hereby
created the Salt Lake City Community Development Advisory
Committee, hereinafter Committee, which body shall consist of 15
members who reside in Salt Lake City.
Sec. 25-30-3. Purpose. The purpose of the Committee is to
provide citizens with an ample opportunity to participate, in an
advisory role, in the City's planning and assessment of its
community development program . Although members of the Committee
serve only in an advisory role , their involvement is necessary in

order to obtain the opinions of those people who live and work in
various neighborhoods to aid the City in identifying the needs
within those areas, and projects to be completed with the City' s
community development funds.
Sec. 25-30-4 . Appointment. Oath of office. ( 1) All
appointments of members of the Committee shall be made by the
Mayor with the advice and consent of the City Council . In making
initial appointments, the Mayor shall , with the advice and
consent of the Council , designate five members to serve one
years , five to serve two years, and five to serve three years .
Thereafter all appointments shall be made for a three year
term. Each membe r' s to nn of office shall expire on the
applicable first Monday in July, but he or she shall continue to
hold that office until his or her successor is appointed and
qualified . Each member shall perform service on a voluntary
basis without compensation and on such basis shall be immune from
liability with respect to any decision or action taken during the
course of these services as provided by Utah Code Annotated ,
Section 63-3-1 et seq. ( 1953) as amended . Members shall sign the
oath of office required by law to be signed by City officials and
file the same in the office of the City Recorder. Every member
who shall within ten ( 10) days after notification of his or her
appointment to file with the City Recorder his or her oath of
office to perform faithfully, honestly and impartially the duties
of the office, shall be deemed to have refused such appointment,

and thereupon another person shall be appointed in the manner
prescribed in these ordinances. Vacancies occurring in the
membership of the board shall be filled by appointment by the
Mayor with the advice and consent of the Council for the expired
term .
( 2 ) Of the appo intments to be made by the Mayor, at least
one member shall be appointed from each council district. In
making such appointments the Mayor will take into consideration
the demographic composition of the City and should include
representatives of low and moderate income , ethnic minorities,
handicapped and elderly persons as well as female-headed
households.
Sec . 25-30-5. Removal from office. Any member may be
removed from office by the Mayor prior to the normal expiration
of the term for which such member was appointed .
Sec. 25-30-6. Members' ethics. Members shall be subject to
and bound by the provisions of the City' s conflict of interest
ordinance Section 24-13-1 et seq. , Revised Ordinances of Salt
Lake City, 1965, as amended . Any violations of the provisions of
said act shall be grounds for removal from office .
Sec . 25-30-7. Eligibility for membership. A person to be
eligible to be appointed as a member of the Ccmmittee shall meet

the following prerequisites:
( 1) Be at least 18 years of age .
( 2 ) Be a resident of the City of Salt Lake .
Sec . 25-30-8. Meetings. The Committee shall convene
regular meetings to be held at least monthly throughout the
year. The Committee shall hold its meetings in compliance with
the Utah Open and Public Meetings Act. Special meetings may be
ordered by a majority of the Committee , the chairperson , or the
Mayor. The order for a special meeting must be signed by a
member calling such meeting and , unless waived in writing , each
member joining in the order for such special meeting must be
given not less than three hours notice. Such notice shall be
served personally or left at the member' s residence or business
office . Meetings shall be held at such public place as may be
designated by the Committee. Eight members of the Committee
shall constitute a quorum for the transaction of business. The
Committee shall cause a written record of its proceedings to be
available for public inspection in the office of the City
Recorder. The Committee shall record the yea and nay votes of
the Committee members on any action taken by it. The Committee
shall adopt a system of rules and procedure under which its
meetings are to be held. The Committee may suspend the rules of
procedure by unanimous vote of the members of the Committee who
are present at the meeting. The Committee shall not suspend the
rules or procedure beyond the duration of the meeting at which

the suspension of rules occurs.
Sec . 25-30-9. Election of Committee Officers. Each year
the Committee at its first regular meeting after the third Monday
in September shall select one of its members as chairperson, and
another of its members as vice chairperson who shall assume the
duties of the chairperson during the absence or disability of the
chairperson.
Sec. 25-30-10 . Subcommittees. The Committee may designate
such subcommittee or committees as it desires to study, consider
and make recommendations on matters which are presented to the
Committee .
Sec . 25-30-11 . Responsibilities. The Committee shall have
the following responsibilities :
( 1) To serve solely in an advisory role on decisions
relating to the City's Community Development Block Grant
programs.
( 2 ) To coordinate with the Capital Planning and Programming
division of the City on review and evaluation planning for
community development target areas, and review of current goals
and policies of the community development program.
( 3 ) To review all eligible annual and slippage or
contingency project proposals submitted by various individuals ,
neighborhood groups, community organizations and City
departments, and make recommendations to the Mayor on such
request for funds.

(4 ) To discuss program and project monitoring information
prepared by the City to ensure that the projects are implemented
as planned .
( 5 ) To assure that CDBG goals are consistent with the
Housing Assistance Goals of the City.
(6 ) To evaluate the overall effectiveness of the Community
Development Block Grant program activities.
(7 ) To be responsible for establishing and maintaining
communications with the Salt Lake City Community Councils .
Sec. 25-30-12 . Attorney. Any legal advice or assistance
desired shall be obtained only from the office of the City
Attorney.
Sec. 25-30-13 . Sunset. The Committee established hereby
and this ordinance shall terminate and cease to be effective upon
the termination of Federal Community Block Grant money being
appropriated, and those funds previously paid to the City
heretofore are used up.
Sec . 25-30-14 . Severability. The provisions of this
ordinance shall be severable; and if any provision thereof, or
the application of such provision under any circumstances is held
invalid, it shall not affect any other provision of this
ordinance, or the application in a different circumstance.
SECTION 2. This ordinance shall take effect upon first
publication.
