No. 61 of 1997
(Closing a portion of Elizabeth Street,
pursuant to Petition No. 400-96-93)
AN ORDINANCE CLOSING A PORTION OF ELIZABETH STREET LOCATED
NORTH OF WILMINGTON AVENUE, PURSUANT TO PETITION NO. 400-96-93.
WHEREAS, the City Council of Salt Lake City, Utah, finds
after public hearing that the City's interest in the portion of
the street described below is not necessary for use by the public
as a street and that closure of said street will not be adverse
to the general public's interest; and
WHEREAS, the title to the closed portion of said street
shall remain with the City until sale for fair market value or
the receipt of equivalent value;
NOW, THEREFORE, be it ordained by the City Council of Salt
Lake City, Utah:
SECTION 1. That a portion of Elizabeth Street located north
of Wilmington Avenue, which is the subject of Petition No. 400-
96-93, and which is more particularly described below, be, and

the same hereby is, closed and declared no longer be needed or
available for use as a street.
BEGINNING at the southwest corner of Lot 7, Block 8, Union
Heights Subdivision, according to the official plat thereof,
filed in Book "F" of Plats, at Page 11 of the official
records of the Salt Lake County Recorder, and running thence
North 89°46'05" West along the North line of Wilmington
Avenue 66.06 feet to the Southeast corner of Lot 23, Block
9, said Union Heights Subdivision; thence North 00°20'37"
East along the East line of Block 9, said Union Heights
Subdivision 302.53 feet to the Northeast corner of Block 9,
said Union Heights Subdivision; thence South 89°53'11" East
65.99 feet to the Northwest corner of Lot 1, Block 8, said
Union Heights Subdivision; thence South 00°19'50" West along
the West line of said Block 8, 302.66 feet to the point of
the BEGINNING.
SECTION 2. Reservations and Disclaimers. The above closure
is expressly made subject to all existing rights of way and
easements of all public utilities of any and every description
now located on and under or over the confines of the property and
also subject to the rights of entry thereon for the purposes of
maintaining, altering, repairing, removing or rerouting said
utilities, including the City's water and sewer facilities. Said
closure is also subject to any existing rights of way or
easements of private third parties.
SECTION 3. Transfer of Title. The title to this closed
portion of said alley shall remain with City until sale for fair

market value, or the receipt of equivalent value.
SECTION 4. Conditions. This street closure is subject to
the following conditions:
1. That the Petitioner comply with all of the terms and
conditions of Conditional Use No. 410-244, Conditions of
Approval, as approved by the Planning Commission and the Planning
Commission Design Review Committee;
2. The City shall recommend the use of a conservation
easement in connection with the development of the Hidden Hollow
Nature Area Master Plan; and
3. That the Petitioner agree, in writing, to provide space
for a police station (cop shop) at an acceptable and accessible
location on the premises.
SECTION 5. Effective Date. This ordinance shall become
effective on the date of its first publication and shall be
recorded with the Salt Lake County Recorder. The City Recorder
is instructed not to record or publish this ordinance until the
conditions identified above have been met, as certified by the
Salt Lake City Planning Director. If the conditions identified
above have not been met within one year from the date of this
ordinance, the City Recorder is instructed not to record or

publish this ordinance, which shall become null, void and have no
effect.
Passed by the City Council of Salt Lake City, Utah this 16th
day of September , 1997.
