061 of 2005 - Clarifying the definition of handicapped person; special transportation vehicle; exemptions of chapt 0 05-1 0 05-23 SALT LAKE CITY ORDINANCE No. 61 of 2005 (Transportation of Handicapped Persons) AN ORDINANCE AMENDING SECTION 5.76.040, SALT LAKE CITY CODE, CLARIFYING THE DEFINITION OF HANDICAPPED PERSON; AMENDING SECTION 5.76.080, SALT LAKE CITY CODE, CLARIFYING THE DEFINITION OF SPECIAL TRANSPORTATION VEHICLE, AND AMENDING SECTION 5.76.590, SALT LAKE CITY CODE, RELATING TO EXEMPTIONS OF CHAPTER APPLICABILITY. WHEREAS, an issue has arisen with regard to the Council's previous intent in enacting certain language in Chapter 5.76 of the Salt Lake City Code, pertaining to transportation of handicapped persons; and WHEREAS, the aforementioned issue relates to whether or not the Council intended to exclude from applicability of Chapter 5.76 the transportation of handicapped persons by ambulances or taxicabs whether or not such ambulances or taxicabs may be designed or equipped with special equipment provided for in this chapter; and WHEREAS, it is the intent of the Council in enacting this ordinance to clarify that its intent was previously and continues to be to exempt from the applicability of Chapter 5.76, Salt Lake City Code, the transportation of handicapped persons by ambulances or taxicabs whether or not such ambulance or taxicab may be designed or equipped with special equipment provided for in said chapter; Now, Therefore, Be it ordained by the City Council of Salt Lake City, Utah: 1 SECTION 1. That Section 5.76.040, Salt Lake City Code, clarifying the definition of handicapped person be, and the same hereby is, amended to read as follows: 5.76.040 Handicapped Person: "Handicapped person" means a person who is not acutely ill, who does not for any reason require the services of an ambulance, and who, by reason of physical or mental infirmity, may not be conveniently transported on public mass transportation, other than in a taxicab, without the special equipment provided for in this Chapter. SECTION 2. That Section 5.76.080, Salt Lake City Code, pertaining to definition of special transportation vehicle be, and the same hereby is, amended to read as follows: 5.76.080 Special Transportation Vehicle: "Special transportation vehicle" means any self-propelled motor vehicle for hire, other than an ambulance or taxicab, which vehicle is designed, equipped and used for the transportation of handicapped persons, as defined in this Article. SECTION 3. That Section 5.76.590, Salt Lake City Code,pertaining to exemptions to chapter applicability be, and the same hereby is, amended to read as follows: 5.76.590 Exemptions To Chapter Applicability: The provisions of this Chapter shall not be deemed to have any application to the transportation by the City, any of its departments, or to any driver performing such transportation, or to the transportation of handicapped persons by an ambulance or a taxicab, whether or not such ambulance or taxicab is designed or equipped with the special equipment provided for in this chapter. 2 . SECTION 4. This ordinance shall take effect immediately upon the date of its first publication.
