063 of 1995 - Amending Sections 17.36.080, 17.52.050, 17.52.110, 17.72.020 and 17.72.030,0 95-1 0 95-13 SALT LAKE CITY ORDINANCE No. 61 of 1995 (Amending Sections 17.36.080, 17.52.050, 17.52.110, 17.72.020 and 17.72.030, Salt Lake City Code, relating to wastewater control and the City's sewer system) AN ORDINANCE AMENDING SECTIONS 17.36.080, 17.52.050, 17.52.110, 17.72.020 AND 17.72.030, SALT LAKE CITY CODE, RELATING TO WASTEWATER CONTROL AND THE CITY'S SEWER SYSTEM; MAKING CERTAIN TERMINOLOGY CHANGES; ADDING A NEW SCHEDULE FOR LOCAL LIMITS; AMENDING MINIMUM FEES; DELETING REDUNDANT SCHEDULES FOR PERMIT FEES AND ASSESSMENT FEES; AND RELATED MATTERS. Be it, and it is hereby ordained by the City Council of Salt Lake City, Utah as follows: SECTION 1. Section 17.36.080(B)(3), Salt Lake City Code, is hereby amended to read as follows: "3. than 6.0;" pH Limits. Any wastewater having a pH less SECTION 2. Section 17.52.050, Salt Lake City Code, is hereby amended to read as follows: "17.52.050 Permit --Duration. A wastewater discharge authorization for each residential user shall remain in effect until terminated by the POTW. All other permits shall be issued for a specified time period, not to exceed five years. A permit may be issued for a period less than a year, or may be stated to expire on a specified date. Any permit may be canceled or terminated for failure to comply with the requirements of this chapter." SECTION 3. Section 17.52.110(B), Salt Lake City Code, is hereby amended to read as follows: "B. The POTW or other authorized regulatory agencies shall have the right to set upon the user's property or any other representative location such devices as are deemed necessary to conduct sampling inspection, compliance monitoring and/or metering operations." SECTION 4. Section 17.72.020, Salt Lake City Code, is hereby amended to read as follows: "17.72.020 Schedule 2--Local limits. SCHEDULE 2 LOCAL LIMITS 2 A. B. All metals limits, except mercury and silver, are monthly average limits. An upper pH limit will be set forth in the permit. C. Users discharging wastewater with concentrations in excess of the concentrations listed below shall be subject to a surcharge in the amount also listed below. The volume of 3 wastewater used to compute the surcharge shall be based upon the volume of wastewater used to compute the regular sewer user fee. SECTION 5. Section 17.72.030, Salt Lake City Code, is hereby amended to read as follows: "17.72.030 Schedule 3--Rates and Fees. SCHEDULE 3 RATES AND FEES A. Purpose. * * * B. Definitions. 4 7. 8. * * * * C. Sewer Charge. 1. User Service Rate. Each sewer service account shall be charged three dollars and fifteen cents per month minimum charge for up to three hundred cubic feet of water, or eighty cents per one hundred cubic feet, as determined by the city through the water meter, of the average monthly water meter readings of those using solely city water during the consecutive months of November, December, January, February and March each year, hereafter "winter readings," whichever is higher. Such winter readings shall be the basis for sewer billings for the period July 1st through June 30th following such winter readings. Any user who had more than one water meter, one or more of which measures water eventually discharged into the sewer, and one or more other meters measuring water not entering the sewer, will be charged eighty cents per one hundred cubic feet for all water used which may enter the sewer, but will not be assessed a sewer charge on water meter(s) which measure water no part of which flows in the sewer system. For those not using city water or using some city water the city may require a city approved meter, at the sewer user's expense, on the well(s) or other source(s) of water supply, for measurement by city during said months to determine the sewer user's water use during said months, the average of which shall become the basis for sewer billings for said period. For each single dwelling unit not using city water and desiring not to install a water meter as required above, the director may waive the meter requirement, in which event the user will be charged for sewer service as provided in subparagraph (a) hereof. 2. User Service Rate No. 2. (a) Whenever the city determines that one or more of the conditions set forth in subsection (2)(b) apply, an industrial user shall be subject to user rate No. 2, which shall be equal to a minimum charge of $50, plus 1.35 times the service charge in paragraph (C)(1). Such rate shall apply beginning with the first billing cycle, effective immediately, and shall continue until the industrial user remedies such violation. When any of the options in this subsection exceed six consecutive billing cycles, the user service rate No. 3 shall be imposed. (b) When industrial user rate No. 2 shall apply: (i) After any violation of the discharge permit limits and/or requirements set forth in city ordinances. Samples in violation of such discharge permit may be repeated with sampling and analysis to document validity of the initial results. If the follow up sampling and testing confirms the noncompliance, industrial user rate No. 2 will be in effect from the time of the first analysis; * * * 3. User Service Rate No. 3. (a) Whenever the city determines that one or more of the conditions set forth in subsection (3)(b) apply, an industrial user shall be subject to user rate No. 3, which shall be equal to a minimum charge of $100, plus 1.50 times the service charge in paragraph 3(a) above, until compliance with the permit has been achieved as demonstrated by three consecutive months in total compliance with the provisions of the permit and applicable city ordinances. The city will determine analysis procedures and testing frequency during the entire period. (b) When industrial user rate No. 3 shall apply: * * * (iii) * * * (iv) * * * 4. The imposition of user rate No. 2 or user rate No. 3 is intended to defray costs and expenses incurred by the City's Public Utilities Department as a result of the applicable violation, and shall not preclude the City or any other regulatory agency having jurisdiction from pursuing any civil or criminal penalties available at law. The charge for installation of sewer special wyes shall be determined by the director which cannot exceed the city's actual cost plus reasonable overhead. 7. (a) Residential single dwelling, and condominium, and twin homes per connection or unit $500 (b) Multifamily dwellings (i) Duplex $750 (ii) Triplex $1,125 (iii) Townhouse, (apartment), per unit $375 (c) Hotels and motels 10 (i) Per dwelling unit without kitchen or restaurant $250 (ii) Per dwelling unit with a kitchen or restaurant $333 (iii) Per dwelling unit with kitchen and a restaurant $333 (d) General commercial and industrial uses, per each equivalent fixture unit (based on Utah Plumbing Code) $25 (e) Trailer parks, per equivalent unit (three trailer spaces shall equal one residential single dwelling unit) . . $500 (f) Recreation parks per equivalent unit (six trailer spaces shall equal one residential single dwelling unit) $500 (g) Special industrial and commercial uses, including carwashes, laundromats, etc., as determined by the city's public utilities director, shall be charged $25 per equivalent 11 fixture unit, as specified in the Uniform Plumbing Code. 10. * * * (a) (b) * * * * * * 11. Temporary sewer connections may only be made by approval of the director. Temporary connections cannot exceed twenty-four months. The fee for each temporary connection shall be one hundred dollars. All other applicable fees will be effective for temporary connections." SECTION 6. All section headings and titles shall be amended as appropriate to reflect the amendments effected by this ordinance. SECTION 7. EFFECTIVE DATE.
