065 of 1993 - AN ORDINANCE ENACTING NEW SECTIONS 6.08.081 THROUGH .089 TO THE SALT LAKE CITY CODE, CREATING A CLAS0 93-1 P 93-346 SALT LAKE CITY ORDINANCE No. 65 of 1993 (Enacting a Class "F" Liquor License for Brew Pubs and Microbreweries Pursuant to Petition No. 400-93-55) AN ORDINANCE ENACTING NEW SECTIONS 6.08.081 THROUGH .089 TO THE SALT LAKE CITY CODE, CREATING A CLASS "F" LIQUOR LICENSE FOR BREW PUBS AND MICROBREWERIES PURSUANT TO PETITION NO. 400-93-55. WHEREAS, the City Council of Salt Lake City, Utah, finds after public hearing that it is in the best interest of the City to create a new class "F" liquor license to regulate the location and operation of brew pubs and microbreweries; NOW, THEREFORE, BE IT ORDAINED by the City Council of Salt Lake City, Utah: SECTION 1. That Sections 6.08.081 through .089 be, and the same hereby are, enacted to read as follows: 6.08.081 Class "F" licenses --Brew Pubs and Microbreweries: Definitions. The following definitions are applicable to the provisions of Sections 6.08.081 through .089. A. "Bar area" means an area of the licensed premises separated from the restaurant service area by a substantial physical barrier. B. "Brew Pubs" means restaurant -type establishments that also have a beer brewery, producing beer in batch sizes not less than seven U.S. barrels (31 gallons), on the same property which produces only enough beer for sale and consumption on site or for retail carry -out sale in containers holding less than two liters. At least fifty percent of the beer sold shall be brewed on the premises. Revenue from food sales shall constitute at least fifty percent of the total business revenues, excluding retail carry -out sales of beer. C. "Major Streets" means those streets identified as Major Streets on City Map No. 19372. D. "Microbrewery" means a Brew Pub which, in addition to retail sale and consumption on -site, markets beer wholesale in an amount not to exceed sixty thousand barrels (thirty-one gallon) per year. Revenue from food sales shall constitute at least fifty percent of the total business revenues, excluding wholesale and retail carry -out sales of beer. 6.08.082 Brew Pubs and Microbreweries: Allowable zoning. Brew Pubs may be allowed in Commercial "C-3" and "C-4" zones and all Industrial "M" series zones. Microbreweries may be allowed only in Industrial "M" series zones. 6.08.083 Brew Pubs and Microbreweries: Proximity requirements. The provisions of Section 6.08.120.B. shall apply to Class "F" licenses. 6.08.084 Brew Pubs and Microbreweries: Spacing. A. Brew Pubs and Microbreweries shall be located so as to front on a major street or be within a building the main entrance of which building fronts on a Major Street. This provision may be waived or modified in the same manner as for Class "C" and Class "B" Private Club licenses. B. The provisions of Section 6.08.120.B. shall apply to Class "F" licenses. 6.08.084 Brew Pubs and Microbreweries: Spacing. A. Brew Pubs and Microbreweries shall be located so as to front on a major street or be within a building the main entrance of which building fronts on a Major Street. This provision may be waived or modified in the same manner as for Class "C" and Class "B" Private Club licenses. B. Only one Brew Pub or Microbrewery may be located on 2 either side of a Major Street between the intersections of two Major Streets. 6.08.085 Brew Pubs and Microbreweries: Liquor Districts. Brew Pubs and Microbreweries may be located only within liquor districts "A", "B" or "C". 6.08.086 Brew Pubs and Microbreweries: Other Applicable Provisions. The provisions of Sections 6.08.100 through .230, except .180, shall apply to Class "F" licenses. 6.08.087 Brew Pubs and Microbreweries: Interior design. The application for a Class "F" license shall provide an interior design drawnto scale showing the restaurant area, the bar area (if any) and describing the physical barrier separating the restaurant area from the bar area. 6.08.088 Brew Pubs and Microbreweries: Minors. Any other provision of this title notwithstanding, minors accompanied by a person twenty-one years of age or older may be permitted in Class "F" licenses subject to the provisions of Section 6.08.089. 6.08.089 Brew Pubs and Microbreweries: Criminal Provisions Regarding Minors. It is unlawful and shall constitute an offense of strict liability: A. For any person under the age of twenty-one years or for a Class "F" licensee to allow such a minor, to enter or be served in the bar area; 3 B. To serve or allow the consumption of beer by persons under twenty-one years of age; C. To serve or allow the consumption of beer in single serving containers larger than twenty-three fluid ounces except in the bar area. SECTION 2. EFFECTIVE DATE. This ordinance shall take effect immediately upon the date of its being first publication.
