066 of 1988 - Creation of Section 18.20.220 Providing for Waiver of Building Fees for Low-Income 400-636-88 0 88-1 r P 88-291 SALT LAKE CITY ORDINANCE No. 66 of 1988 (An ordinance creating Section 18.20.220 providing for waiver or deferral of building fees for low-income assistance pursuant to Petition No. 400-636-88) AN ORDINANCE CREATING SECTION 18.20.220 PROVIDING FOR THE WAIVER OR DEFERRAL OF BUILDING FEES FOR LOW INCOME-ASSISTANCE PURSUANT TO PETITION NO. 400-636-88. WHEREAS, the City Council of Salt Lake City, Utah, has considered procedures and standards for the waiver of certain building fees to aid non-profit entities in helping the City meet the needs of low-income housing and believes the following procedures and standards to be appropriate. Be it therefore ordained by the City Council of Salt Lake City, Utah: SECTION 1. That Section 18.20. 220 be enacted to read as follows: 18.20.220. Waiver or Deferral of Fees. Non-profit organizations may petition the City for the waiver or deferral of any or all fees required by this title on an annual or project- by-project basis. Such petitions shall be filed with the Housing Appeals and Advisory Board which shall hold an informal hearing on the petition after notice of the hearing has been posted for seven (7) days in the office of the City Recorder. Waiver of fees shall not be permitted for projects of four or more dwelling units. The Board may recommend granting the waiver or deferral if it finds that the project or projects and the sponsoring non- profit organization furthers the City' s established low-income housing goals and meets all applicable guidelines established for any such programs by the United States Department of Housing and Urban Development. The recommendation of the Board will be made to the Director of Development Services who shall issue the decision of the Department. Any person or entity dissatisfied with the decision of the Director may appeal such decision to the Mayor or the Mayor' s designee whose decision shall be final. The Board may not grant a waiver or deferral to any organization which owns, operates, manages or is related by common ownership or management to any other such organization which owns, operates or manages buildings for which existing notices of code violations have not been cured. SECTION 2. This Ordinance shall take effect on the date of its first publication. Passed by the City Council of Salt Lake City, Utah, this 4th day of October , 1988.
