WHEREAS, Petition No. 400-93-14 was filed with the City by Wayne C. and Vella N. Evans, requesting the City to allow the amendment of the Gilmer Park Subdivision to allow the reconfiguration of Lots 18, 18A, 19 and 19A; and WHEREAS, one hundred percent of the owners of the property within and adjacent to the subdivision have not consented to the amendment; and WHEREAS, the City Council has held a public hearing after giving the required notices and has reviewed the preliminary plat amendment which has been previously preliminarily approved by ',lie Planning Commission on June 3, 1993; and WHEREAS, good cause exists for the amendment of the plat and the City Council finds neither the public nor any person will be materially injured by the proposed amendment; NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: • CO Pc Cn CO co CD C) PO CD SECTION 1. The City hereby approves the modified proposed amendment to the Gilmer Park Subdivision as conditionally approved by the Planning Commission on June 3, 1993. A copy of the amended plat shall be retained by the City Recorder as Exhibit A to this Ordinance. The Plazming Director is authorized to grant final plat approval subject to compliance with applicable City ordinances and the conditions imposed by the Planning Commission. SECTION 2. CONDITIONS. This ordinance shay. be conditioned upon the petitioners' conveyance to the City of Lot 18A in a form to be approved by the City, for the purpose of the City constructing a park as the time and resources may permit. Subject to the City's approval, the park, when constructed, will be named by the Petitioners' family and/or appropriate neighbor- hood groups. SECTION 3. EFFECTIVE DATE. This ordinance shall take effect immediately upon the date of its being first published and recorded with the Salt Lake County Recorder. The City Recorder is instructed to not record or publish this ordinance until the Planning Division certifies that the amended plat is approved and recordable and that the conditions described in Section 2 have been complied with. The petitioners shall have one year to comply with the provisions of Section 2 and the approval of the plat. The Mayor may extend this period for an additional year.
