Crandall Deputy City Recorder 0 98-1 P 98-60 SALT LAKE CITY ORDINANCE No. 66 of 1998 (Vacating a portion of the Kinney & Gourlay's Improved City Plat Subdivision, Pursuant to Petition No. 400-98-01) AN ORDINANCE VACATING A PORTION OF THE KINNEY & GOURLAY'S IMPROVED CITY PLAT SUBDIVISION, AS REQUIRED BY § 10-9- 808, UTAH CODE ANNOTATED, PURSUANT TO PETITION NO. 400-98-01. WHEREAS, Petition No. 400-98-01 was filed with the City requesting that the City vacate a portion of the Kinney & Gourlay improved City Plat Subdivision; and WHEREAS, one hundred percent of the owners of the property within and adjacent to the subdivision have not consented to the vacation; and WHEREAS, the City Council has reviewed the proposed vacation which has been preliminarily approved by the Planning Commission on April 23, 1998; and WHEREAS, good cause exists for the vacation of the portion of the subdivision and the City Council finds that neither the public nor any person will be materially injured by the proposed vacation; NOW, THEREFORE, be it ordained by the City Council of Salt Lake City. Utah: SECTION 1. The City hereby approves the proposed vacation of a portion of the Kinney & Gourlay's Improved City Plat Subdivision, as conditionally approved by the Planning Commission on April 23, 1998. The portion of the subdivision to be vacated is more particularly described as set forth on Exhibit "A" attached hereto. SECTION 2. Conditions. This subdivision vacation is subject to the following conditions: 1. The future development of this property will require full frontage roadway improvements to be installed along Warm Springs Road as required by the city engineer, or to provide a special improvement district waiver. 2. All new drive approaches to the property must be approved and be consistent with the requirements of the Division of Transportation. 3. The property owner must meet all division and departmental requirements and regulations set forth in city ordinances. SECTION 3. Effective Date. This ordinance shall take effect upon the date of its first publication and shall be recorded with the Salt Lake County Recorder.
