SALT LAKE CITY ORDINANCE
No. 67 of 2018
(Amending Chapter 5.64 of the Salt Lake City Code pertaining to
Solicitation, Peddling and Sales Promotion)
An ordinance amending Chapter 5.64 of the Salt Lake City Code pertaining to
Solicitation, Peddling and Sales Promotion.
WHEREAS, it is proposed that Chapter 5.64 of the Salt Lake City Code,be amended to
condense and simplify the permit requirements for face-to-face solicitation and selling; and
WHEREAS, public safety and entrepreneurship are priorities for Salt Lake City; and
WHEREAS, simplifying the requirements for face-to-face solicitation permits will help
ensure applicants understand the process so that permits are easily and properly obtained; and
WHEREAS, properly obtained face-to-face solicitation permits will identify individuals
desiring to solicit business, which can assist in protecting the residents of the City; and
WHEREAS, modifying the requirements for face-to-face solicitors will enhance
consistency between the Salt Lake City Code and the Utah State Code; and
WHEREAS, the Salt Lake City Council finds adoption of this ordinance reasonably
furthers the health, safety, and general welfare of the citizens of Salt Lake City.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City:
SECTION 1. Amending the Text of Salt Lake City Code Article II of Chapter 5.64. That
Article II of Chapter 5.64 (Interstate and Intrastate Commerce Solicitation and Selling) of the
Salt Lake City Code shall be, and hereby is, amended to read as follows:

5.64.120: SOLICITATION PERMIT PURPOSE:
5.64.130: SOLICITATION PERMIT REQUIREMENT:

5.64.120: SOLICITATION PERMIT PURPOSE:
This article shall be interpreted and administered so as to give greatest effect to the public
policy of the City, which seeks to exercise the police power of the City for the purpose of
identifying individuals desiring to solicit business within the corporate limits of the City and
for the protection of the residents of the City.
5.64.130: SOLICITATION PERMIT REQUIREMENT:
It is unlawful for any person to engage in face-to-face solicitation for the sale, lease, or rental
of consumer goods or services, whether under single or multiple contracts, in which the seller
personally solicits the sale at the residence or place of employment of the buyer upon or along
the streets of the City without first obtaining a permit for solicitation from the City and
carrying such permit on their person while engaged in face-to-face solicitation.
5.64.140: SOLICITATION PERMIT REGISTRATION:
A. Registration Form: The person desiring to engage in face-to-face solicitation pursuant to
this article shall complete a registration form showing his or her name and address and the
name and address of the person, firm, or corporation that said person represents. The
registration form shall be obtained at the Salt Lake City Police Department.
B. Photograph: At the time of registering, the person desiring to engage in solicitation
activities pursuant to this article shall furnish the Salt Lake City Police Department with
one passport-style photograph and shall sign his or her name on the registration record.
C. Registration Fee: The Salt Lake City Police Department shall collect from each person
registered pursuant to this article, at the time of registration, the fee shown on the Salt Lake
City consolidated fee schedule, which fee shall be remitted by the Police Department to the
City Treasurer.
D. Identification Card: Upon payment of the registration fee, and provided the person has
completed and satisfactorily met all of the requirements of this article, the Salt Lake Police
Department may issue an identification card to the applicant, which shall constitute a
permit for solicitation as provided in this article for the period of time stated thereon.
5.64.150: SOLICITATION PERMIT EXEMPTIONS:
A. Religious and Charitable Solicitations: The requirements of this article shall not apply to
persons or organizations conducting religious or charitable solicitations that are registered

with the Utah Division of Consumer Protection as required by the Utah Charitable
Solicitation Act or its successor.
B. Duplicative Licensure under Utah State Law:
1. The requirements of this article shall not apply to persons that have already lawfully
obtained a license as an alarm company agent under Utah Code § 58-55-301, or its
successor section, and who are only engaging in face-to-face solicitation activities
covered by their alarm company agent license.
2. It is unlawful for a person who has obtained a license as an alarm company agent
under Utah Code § 58-55-301, or its successor section, to engage in a face-to-face
solicitation for any product or service not covered by their alarm company agent
license without first obtaining a permit for solicitation as set forth in this article.
SECTION 2. Repealing Article VI of Chapter 5.64. That Article VI of Chapter 5.64
(Miscellaneous Door To Door Sales) of the Salt Lake City Code shall be, and hereby is,
repealed in its entirety.
SECTION 3. Effective Date. That this ordinance shall take effect immediately upon the
date of its first publication.
