Lake City, Utah, pursuant to
Petition No. 400-406 of 1986
AN ORDINANCE CLOSING PIONEER ROAD AT APPROXIMATELY 2565
WEST CALIFORNIA AVENUE IN SALT LAKE CITY, UTAH, AND REQUIRING
CERTAIN CONDITIONS.
The City Council of Salt Lake City,Utah, finds after public hearing that the City's
interest in the public street described below is no longer necessary for use by the public as
a street and that closure of said street with the reservation of certain easements will not be
adverse to the general public's interest nor will it relinquish or terminate the City's
interest in the underlying property without separate documents of transfer.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That that public street which is the subject of Petition No. 400-406
of 1986, which is more particularly described below, be, and the same hereby is CLOSED
and declared no longer to be needed or available for use as a public right of way; and the
title to the City's interest thereon shall be reserved and retained by Salt Lake City
Corporation, until conveyed pursuant to separate documents of transfer upon satisfaction
of the conditions set forth in Section 2.
COMMENCING at the monument at the intersection of 1500 South Street
and Pioneer Road, Salt Lake City, Utah; thence North 00°03'08°° West
along the monument line 576.76 feet to a found spike being South
00°36'32°° East 365.51 feet from the North One Quarter Corner of Section
16, Township 1 South, Range 1 West, Salt Lake Base and Meridian; thence
South 89°56'52°° West 25.00 feet to a point on the West Line of Pioneer
Road, said point being North 4919.62 feet (Deed) and West 29.41 feet
(Deed) from the South One Quarter Corner of said Section 16, said point
also being on a point of curvature to the left having a radial bearing of
South 89°56'52°° West and a radius of 227.42 feet; thence Northerly and
Westerly along the Arc of said curve 357.23 feet; thence South 89°56'52°°
West 1229.52 feet to the point of BEGINNING, said point being the
Northwest Corner of that tract of land described and conveyed to Utah
Power and Light Company by Warranty Deed dated December 22, 1975 as
entry number 2775369 in Book 4073, page 286 in the office of the
Recorder of Salt Lake County, Utah and running thence South 89056'52"
West 742.15 feet; thence North 00°03'08" West 50.00 feet; thence North
89°56'52" East 742.19 feet; thence South 50.00 feet to the point of
BEGINNING. Contains 0.852 Acres.
DISCLAIMER. Said closure is expressly made subject to all existing rights of
way and easements of all public utilities of any and every description now located on and
under or over the confines of the above described property and also subject to the rights of
entry thereon for the purposes of maintaining, altering, repairing, removing or rerouting
said utilities, including the City's water and sewer facilities, and all of them. Said closure
is subject to any existing rights of way or easements of private third parties.
SECTION 2. CONDITIONS SUBSEQUENT. This Ordinance, after passage,
shall be published but shall not become effective until Petitioner:
1. Pays to the City the fair market value of the above described parcel of real
property together with the cost of appraising the same;
2. Files an executed waiver of protest to future improvement. Such waiver
shall be filed prior to the issuance of any building permit;
3. Constructs a hard-surfaced access road, at least 20 feet wide to any
building. Such road shall be constructed in accordance with Salt Lake City Fire
Department directives and shall have such water mains as are necessary to provide
required fire flow for such building.
4. Executes an avigation easement in a form approved by the Salt Lake City
Attorney.
5. Agrees that any building and improvements maintain the required 15 foot
landscaped setback as measured from the property line subsequent to the dedication of
land as provided in paragraph 6 hereof.
6. Dedicates to Salt Lake City the following described real property:
COMMENCING at the monument at the intersection of 1500 South Street
and Pioneer Road, Salt Lake City, Utah; thence North 00°03'08" West
along the monument line 576.76 feet to a found spike being South
00°36'32" East 365.51 feet from the North One Quarter Corner of Section

16, Township 1 South, Range 1 West, Salt Lake Base and Meridian; thence
South 89°56'52" West 25.00 feet to a point on the West Line of Pioneer
Road, said point being North 4919.62 feet (Deed) and West 29.41 feet

Utah; thence North 106.79 feet to the point of BEGINNING; and running
thence South 89°56'52" West 742.245 feet; thence North 00°03'08" West
2.00 feet; thence North 89°55'56" East 356.49 feet; thence North 00°04'04"
West 3.00 feet; thence North 89°55'56" East 385.76 feet; thence South 5.00
feet to the point of BEGINNING. Contains 2642 Square Feet.
SECTION 3. EFFECTIVE DATE. This Ordinance, after the date of its first
publication, shall not become effective until recorded with the Recorder of Salt Lake
County. However, the Recorder of Salt Lake City is instructed not to record this
Ordinance until the Petitioner advises the City Recorder, in writing, that the conditions
subsequent have been completed and the Mayor verifies such completion or that they have
been provided or by executed agreement. Upon verification or satisfaction, the Mayor
may instruct that the Ordinance be recorded. However,if the foregoing conditions are not
completed within twelve (12) months from the effective date of the passage, this
Ordinance shall be null, void and of no effect, and no recording thereafter shall be
allowed.
