AN ORDINANCE VACATING A PORTION OF A PUBLIC RIGHT-OF-WAY
KNOWN AS BADDLEY PLACE NEAR THE SALT LAKE CLINIC BETWEEN 300 AND
400 SOUTH OFF 1000 EAST SUBJECT TO CERTAIN CONDITIONS PURSUANT TO
PETITION NO. 400-926-91.
WHEREAS, the City Council of Salt Lake City, Utah, finds
after public hearing that the City's interest in the public
right-of-way described below is not necessary for use by the
public as a right-of-way and that vacation of said right-of-way
will not be adverse to the general public's interest.
NOW, THEREFORE, be it ordained by the City Council of Salt
Lake City, Utah:
SECTION 1. That a portion of Baddley Place which is the
subject of Petition No. 400-926-91 and which is more particularly
described below, be, and the same hereby is, vacated and declared
no longer to be needed or available for use as a public right-of-
way:
Said right-of-way is more particularly described as follows:
Vacation Portion
Beginning 16.5 feet North of the Southeast corner of
Lot 7 of Block 42, Plat "B", Salt Lake City Survey; and
running thence West 148.62 feet; thence South 33 feet;
thence East 148.62 feet thence North 33 feet to the
place of beginning.
9 SECTION 2. RESERVATIONS AND DISCLAIMERS. The above

vacation is expressly made SUBJECT TO all existing rights -of -way
and easements of all public utilities of any and every
description now located on and under or over the confines of the
property and also SUBJECT TO the rights of entry thereon for the
purposes of maintaining, altering, repairing, removing or
rerouting said utilities, including the City's water and sewer
facilities, and all of them. Said vacation is also SUBJECT TO
any existing rights -of -way or easements of private third parties.
SECTION 3. CONDITIONS. This ordinance shall not become
effective until the Mayor has certified that the following
conditions have occurred:
A. Retention of a twenty (20) foot wide easement over the
area known as Baddley Place sufficient to provide public access
to the residence at 954 East Baddley, until said structure is
demolished, in a form satisfactory to the City Attorney.
B. Plans for a building permit have been approved and
issued by the City for a four (4) unit residential structure,
which plans shall limit the reconstruction of a shared driveway
off 1000 East Street and the area of Baddley Place to twenty-four
(24) feet in width, meeting a City standard for an "open drive
approach".
C. The agreement and escrow between the Salt Lake Clinic
and Mr. Ray Phillip have been executed.
SECTION 4. EFFECTIVE DATE. This ordinance shall become
effective on the date of its first publication and shall be

thereafter recorded with the Salt Lake County Recorder. The City cm

Recorder is instructed not to publish or record this ordinance
until the conditions in Subsection 3 have been met. In the event
that the conditions have not been met within one year the Mayor
may, by certification, extend the time for performance of the
conditions for an additional year. If the conditions have not
been met after one year or the additional certification year this
ordinance shall become null and void and shall not be published
or recorded.
