AN ORDINANCE AMENDING SECTION 51 -12-2 OF THE REVISED
ORDINANCES OF SALT LAKE CITY, UI'AH, 1965, AS AMENDED, RELATING TO
ZONING AND FIXING OF BOUNEARIES OF USE DISTRICTS.
WHEREAS, competing petitions requesting changes of zoning on
the Curtis Park, Curtis School and Foothill Village sites have
been initiated by the Bonneville Hills Neighborhood Council in
Petition 400-348 of 1985 ( requesting rezoning of Curtis School
from a "B-3 " to an "R-2 " classification) , and Petition 400-370 of
1985 by Johansen, Thackery & MacKenzie ( requesting that Curtis
Park , located at 2300 East 1450 South be rezoned from a
Residential "R-2" to a Business "B-3" classification) the City
Council of Salt Lake City , Utah, has held public hearings before
its own body and before the Planning Commission including January
14, 1986. Said Commission and Council have taken into
consideration extensive citizen testimony, proposals for sitings
and information about the demographic details of said ccmmunity
on a detailed basis, and the area' s relationship to the master
plan as part of its deliberations ; and
WHEREAS, as part of its deliberations , the Council has
concluded that any of the negative impacts of the Foothill
Village Shopping Center can be mitigated by changes and siting of
the shopping center which can be implemented by the ccmpletion of

the renovating improvements proposed by petitioners Johansen,
Thackery & MacKenzie , according to the development plans
presented to the City Council at the hearings. A significant
feature of these mitigating efforts is the proposed transfer of
the open space and park now provided by Curtis Park on 2300 East
to a site with better access and better buffering characteristics
for the abutting residential neighborhood on 2200 East at 1450
South. Pursuant to these conclusions, the Council has concluded
that a portion of the requested change from a Business "B-3 " to a
Residential "R-2" classification for the park site along 2200
East is appropriate and has been accommodated under separate
ordinance. Similarly, that the requested change by Petition No .
400-370 of 1985 of the balance of the Curtis Park site from an
"R-2" to a "B-3" use district classification is appropriate for
the development of the ccanmun ity in that area, pursuant to the
conditions stated herein.
THEREFORE, Be it ordained by the City Council of Salt Lake
City, Utah:
SECTION 1. That the Use District Map, as adopted by Section
51 -12-2, of the Revised Ordinances of Salt Lake City, Utah, 1965 ,
as amended , relating to the fixing of boundaries of Use
Districts , be , and the same hereby is AMENDED as follows :
Sec . 51-1 2-2 . Boundaries of Use Districts. That the
following described parcel of real property in Salt Lake City ,
Utah, presently zoned Residential "R-2 " at the proximate site of

the Curtis Park at approximately 2300 East and 1450 South, is
hereby rezoned to a Business "B-3 " Use District classification,
and the Use District Map is amended accordingly.

Beginning at a point S 89 °53 ' 42" E 401.9 feet from the
northwest corner of Lot 15, Block 15, Five Acre Plat
"C" , Big Field Survey, and running thence S 89153142" E
297. 36 feet; thence S 33145157" E 107. 53 feet; thence S
0002 ' 52" E 149. 74 feet ; thence N 89053 ' 42" W 120. 00
feet; thence S 0102 '52" E 48. 0 feet; thence N 89153 '42"

point of beginning .
SECTION 2. CONDITIONS SUBSEQUENT. The property rezoned
herein is presently providing recreational space and will
accommodate the proposed expansion and renovation of Foothill
Village. Passage of this Ordinance at the January 14, 1986
hearing was conditioned upon the petitioner' s executing and
implementing the development plan presented to the City Council
which provides substitution and better siting of the open space
and elimination or mitigation of many negative effects of
parking , traffic , delivery , etc . , imposed upon the neighborhood
by the existing design of the shopping center. Passage of this
ordinance now recognizes that petitioner is implementing the
plans submitted to the Council by: (1 ) transferring the title to
the City for the proposed park on 2200 East and a park easement
on another parcel of property providing the substitute for the
existing Curtis Park , together with a bond sufficient to
guarantee the designed improvements and landscaping of the park

according to plans which have been approved by the Planning
Department and the Parks Department ; and (2 ) filing a completed
building permit application, together with building permit fees,
and working drawings which conform with the development and site
plan presented to the City Council at the public hearing . Said
plans have been inspected by the Planning Department and Building
Official and been preliminarily approved to ensure that they
conform to the plan and otherwise comply with all applicable
building codes and zoning regulations applicable.
SECTION 3. EFFECTIVE DATE. This Ordinance shall not be
published or beccane effective until the Mayor has certified to
the City Recorder that the conditions required by Section 2 have
been completed . Upon the Mayor' s certification the Recorder is
instructed to publish and record the Ordinance which shall then
became effective immediately on publication. If the conditions
are not met within one year they may be extended for one year .
If the conditions are not met within the time as may have been
extended the Ordinance shall be null and vo id .
