City Recorder SALT LAKE CITY ORDINANCE No. 69 of 1991 (Closing a portion of a public right-of-way known as Baddley Place near the Salt Lake Clinic between 300 and 400 South off 1000 East subject to certain conditions pursuant to Petition No. 400-926-91) 0 91-1 P 91-281 AN ORDINANCE CLOSING A PORTION OF A PUBLIC RIGHT-OF-WAY KNOWN AS BADDLEY PLACE NEAR THE SALT LAKE CLINIC BETWEEN 300 AND 400 SOUTH OFF 1000 EAST SUBJECT TO CERTAIN CONDITIONS PURSUANT TO PETITION NO. 400-926-91. WHEREAS, the City Council of Salt Lake City, Utah, finds after public hearing that the City's interest in the public right-of-way described below is not necessary for use by the public as a right-of-way and that closure of said right-of-way will not be adverse to the general public's interest nor divest the City of any title or claim to the property without subsequent documents of transfer. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That a portion of Baddley Place which is the subject of Petition No. 400-926-91 and which is more particularly described below, be, and the same hereby is, closed and declared no longer to be needed or available for use as a public right-of- way: Said right-of-way is more particularly described as follows: Closure Portion Beginning 16.5 feet North and 148.62 feet West of the Southeast corner of Lot 7 of Block 42, Plat "B", Salt Lake City Survey; and running thence West 181.38 feet; thence South 33 feet; thence East 181.38 feet; thence R North 33 feet to the place of beginning. -4� (`) SECTION 2. RESERVATIONS AND DISCLAIMERS. The above closure a.jO ' 9av' is expressly made SUBJECT TO all existing rights -of -way and easements of all public utilities of any and every description now located on and under or over the confines of the property and also SUBJECT TO the rights of entry thereon for the purposes of maintaining, altering, repairing, removing or rerouting said utilities, including the City's water and sewer facilities, and all of them. Said closure is also SUBJECT TO any existing rights -of -way or easements of private third parties. SECTION 3. CONDITIONS. This ordinance shall not become effective until the Mayor has certified that the following conditions have occurred: A. That any residential structures along Baddley Place have been demolished; and B. That the underground waterline in the vicinity of Baddley Place has been closed or rendered otherwise inoperable. C. The agreement and escrow between the Salt Lake Clinic and Mr. Ray Phillip have been executed. SECTION 4. EFFECTIVE DATE. This ordinance shall become effective on the date of its first publication and shall be thereafter recorded with the Salt Lake County Recorder. The City Recorder is instructed not to publish or record this ordinance 2 until the conditions in Subsection 3 have been met. In the event that the conditions have not been met within one year the Mayor may, by certification, extend the time for performance of the conditions for an additional year. If the conditions have not been met after one year or the additional certification year this ordinance shall become null and void and shall not be published or recorded.
