AN ORDINANCE CLOSING PORTIONS OF 900 NORTH FROM BECK STREET
TO APPROXIMATELY 340 WEST; 400 WEST BETWEEN 900 NORTH AND 1000
NORTH EXCEPT FOR A PARCEL TO BE USED IN THE NEW STREET ALIGNMENT;
THE SOUTHERN HALF OF 1000 NORTH FROM BECK STREET TO 400 WEST; AND
AN ALLEY SOUTHEASTWARD FROM 1000 NORTH, PURSUANT TO PETITION NO.
400-93-16.
WHEREAS, the City Council of Salt Lake City, Utah, finds
after public hearing that the City's interests in the public
streets and alley described below are not necessary for use by
the public as streets and alley and that closure of said streets
and alley will not be adverse to the general public's interest
nor divest the City of title to the properties without subsequent
documents of transfer.
NOW, THEREFORE, be it ordained by the City Council of Salt
Lake City, Utah:
SECTION 1. That portions of 900 North from Beck Street to
approximately 340 West; 400 West between 900 North and 1000 North
except for a parcel to be used in the new street alignment; the
southern half of 1000 North from Beck Street to 400 West; and an
alley southeastward from 1000 North, which are the subject of
Petition No. 400-93-16 and which are more particularly described
below, be, and the same hereby are, CLOSED and declared no longer
to be needed or available for use as public streets and alley,
with the title remaining with the City until subsequent sale for
market value:
Said streets and alley are more particularly described on
Exhibits "A", "B" and "C" which are attached and incorporated by
reference.
SECTION 2. RESERVATION AND DISCLAIMERS. The above closures
are expressly made SUBJECT TO all existing rights -of -way and
easements of all public utilities of any and every description
now located on and under or over the confines of the properties
and also SUBJECT TO the rights of entry thereon for the purposes
of maintaining, altering, repairing, removing or rerouting said
utilities, including the City's water and sewer facilities, and
all of them. Said closures are also SUBJECT TO any existing
rights -of -way or easements of private third parties.
SECTION 3. CONDITION. This ordinance shall be conditioned
upon approval by the City of an amended plat for the Lake View
Subdivision showing the realignment of streets as proposed in
Petition No. 400-93-16 and as approved by the Planning
Commission.
SECTION 4. EFFECTIVE DATE. This ordinance shall become
effective on the date of its first publication and shall be
thereafter recorded with the Salt Lake County Recorder. The City
Recorder is instructed not to publish or record this ordinance

until the Mayor certifies that the condition specified in Section
3 above has been met. If the condition has not been met within
one year the Mayor may extend the time for performance of the
condition for an additional year. If the condition has not been
met within one year or any extension this ordinance shall be
