069 of 1994 - Public Dances, Dancehalls and Dance Studios0 94-1 0 94-16 SALT LAKE CITY ORDINANCE No. 69 of 1994 (Public Dances, Dancehalls and Dance Studios) AN ORDINANCE AMENDING SECTIONS 9.04.010, 9.04.020 and 9.04.100, SALT LAKE CITY CODE, RELATING TO DEFINITIONS, LICENSE REQUIREMENT TO CONDUCT DANCES, AND RESTRICTIONS ON HOURS OF OPERATION, RESPECTIVELY. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That Section 9.04.010 of the Salt Lake City Code, Definitions, be, and the same hereby is, amended by adding subsections E and F to read as follows: 9.04.010 Definitions. A. through D. E. "Public schools" means the public education system and higher education system as defined in Article X of the Utah State Constitution and as implemented by appropriate state statutes. F. "Private school" means, for the purposes of this chapter, any school accredited by the state of Utah whether by formal state action, or by state acceptance of accreditation given to an academic program which has been accepted as an alternative to public schools. SECTION 2. That Section 9.04.020 of the Salt Lake City Code, License --Required to conduct dances, be, and the same hereby is, amended to read as follows: 9.04.020 License --Required to conduct dances. It is unlawful to operate any dance within the limits of the city until the place in which the dance may be held shall first have been duly licensed, except as otherwise provided herein. This requirement for a license shall not apply to public or private schools. SECTION 3. That Section 9.04.100 of the Salt Lake City Code, Hours of operation --Restrictions, be, and the same hereby is, amended to read as follows: 9.04.100 Hours of operation --Restrictions. It is unlawful for any person to conduct or maintain, allow or permit any dance, whether within a dancehall licensed by this title or any restaurant, tavern, private club, public or private school, between the hours of two a.m. and eight a.m. of any day. This restriction shall not apply to dancing at annual graduation activities organized or sponsored by public or private schools as defined in this ordinance. SECTION 4. EFFECTIVE DATE.
