069 of 1997 - Closing a portion of Richards Street, pursuant to Petition No. 400-94-290 97-1 P 97-34 Affects Sidwell Nos. 15-12-478-001 through 15-12-478-018 15-12-479-001 15-12-479-008 15-12-479-009 15-12-479-018 Gykthheue SALT LAKE CITY ORDINANCE No. 69 of 1997 (Closing a portion of Richards Street, pursuant to Petition No. 400-94-29) AN ORDINANCE CLOSING A PORTION OF RICHARDS STREET LOCATED BETWEEN 1300 SOUTH AND PAXTON AVENUE, PURSUANT TO PETITION NO. 400-94-29. WHEREAS, the City Council of Salt Lake City, Utah, finds after public hearing that the City's interest in the portion of the street described below is not necessary for use by the public as a street and that closure of said street will not be adverse to the general public's interest; and WHEREAS, the title to the closed portion of said street shall remain with the City; NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, tah: SECTION 1. That a portion of Richards Street located between 1300 South and Paxton Avenue, which is the subject of Petition 1 No. 400-94-29, and which is more particularly described below, be, and the same hereby is, closed and declared no longer be needed or available for use as a street. Beginning at the Northeast corner of Lot 12, Block 6, North Columbia Subdivision; thence East 82.5 feet to the Northwest corner of Lot 11, Block 5; thence South 541.2 feet along the West line of Blocks 5 and 7 to the Southwest Corner of Lot 2, Block 7; thence West 82.5 feet to the Southeast corner of Lot 1, Block 8; thence North 541.2 feet along the East line of Blocks 8 and 6 to the point of beginning. SECTION 2. Reservations and Disclaimers. The above closure is expressly made subject to all existing rights of way and easements of all public utilities of any and every description now located on and under or over the confines of the property and also subject to the rights of entry thereon for the purposes of maintaining, altering, repairing, removing or rerouting said utilities, including the City's water and sewer facilities. Said closure is also subject to any existing rights of way or easements of private third parties. SECTION 3. Title. Title to the property shall remain with the City. SECTION 4. Conditions. The closure of this street is conditioned upon the execution of the easement agreements with the three abutting property owners on the east side of Richards 2 Street which agreements will provide for perpetual right of way easements and access drives to the abutting property owners. The curb face to curb face easement width shall be 38 feet in front of the southernmost abutting property only. The northern and southern portions of the property shall be available for public use at all times. The center portion of the property shall be available for public use except during events at Franklin Quest Field, when the street may be blocked to through traffic. An event shall be defined as all baseball games and any other activity at Franklin Quest Field with expected attendance of over 3,500 people. When such events occur, Salt Lake City Corporation may block access to the property from two hours prior to the beginning of the event until two hours after the end of the event. The easement agreements shall be substantially in the form attached hereto as Exhibit "A." SECTION 5. Effective Date. This ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder. The City Recorder is instructed not to record this ordinance until after receipt of the three signed easement agreements bearing evidence of their recording with the Salt Lake County Recorder. 3 Passed by the City Council of Salt Lake City, Utah this 7th day of October , 1997. MANSELL EAR Mt GIMPAISS RALPH BECKER CITY RECORDER MAYOR City Recorder LETTER OF EXPLANATION REGARDING CONDITIONS IDENTIFIED IN ORDINANCE 69 OF 1997 The City Recorder was instructed not to publish or record this ordinance until three easement agreements were executed and recorded with the Salt Lake County Recorder. Two of the three easements were completed. The third easement with the Soup Kitchen was never executed. According to the latest correspondence with the Public Services Department dated August 9, 2013, there are no plans to ever have that easement executed or recorded. Based on this information Ordinance 69 of 1997 will not be published or recorded with Salt Lake County. See File P 97-34 for e-mail correspondence from the Public Services Department.
