(Amending Salt Lake City Ordinance No. 44 of 1997
which adopted the rate of tax levy for fiscal year 1997-98)
AN ORDINANCE AMENDING SALT LAKE CITY ORDINANCE NO. 44
OF 1997 WHICH ADOPTED THE RATE OF TAX LEVY UPON ALL REAL AND
PERSONAL PROPERTY WITHIN SALT LAKE CITY MADE TAXABLE BY LAW
FOR THE FISCAL YEAR COMMENCING JULY 1, 1997 AND ENDING JUNE
30, 1998.
PREAMBLE
On June 10, 1997, the City Council, through Salt Lake City Ordinance
No. 44 of 1997, adopted the rate of tax levy for fiscal year 1997-98. The
tax levy set by the City Council was based upon a certified tax rate projected
by the Utah State Tax Commission.
Subsequently, on or about August 4, 1997, the City was advised that
the Utah State Tax Commission had determined a certified tax rate lower
than the projected rate given to the City on June 10, 1997. The Utah State
Tax Commission notified the City that unless it received objections by
August 15, it would adjust the City's adopted tax levy to the revised
certified tax rate. The City made no objections to the adjustment.
Under Chapter 2, Title 59 of the Utah Code Annotated, the Utah State
Tax Commission has the authority to lower a tax levy without further action
by the City. Nonetheless, for purposes of its records, the City Council wants
to amend Salt Lake City Ordinance No. 44 of 1997 to reflect the revised
certified tax rate.
Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. Purpose. The purpose of this ordinance is to amend Salt
Lake City Ordinance No. 44 of 1997 to reflect the certified tax rate as
revised by the Utah State Tax Commission.
SECTION 2. Amendment. Salt Lake City Ordinance No. 44 of 1997
shall be and is hereby amended to read as follows:

SECTION 2. For purposes of defraying the necessary and
proper expenses of Salt Lake City to maintain the government thereof
and for operating and maintaining its libraries and reading rooms, the
City Council hereby levies upon all real and personal property within
Salt Lake City made taxable by law in the year 1997, for the fiscal
year of Salt Lake City Corporation ending June 30, 1998, as revenue
in the general fund and as revenue in the library fund, a tax of
0.004387 percent on each dollar of taxable valuation of said property
apportioned as follows:
a. 0.003627 percent shall be credited as revenue in the general
fund;
b. 0.000760 percent shall be credited as revenue in the special
library fund.
Said tax levies shall be subject to Mayor approval and City
Council reconsideration pursuant to Section 10-3-1214 of the Utah
Code Annotated.

SECTION 3. Effective Date. This ordinance shall take effect on its
first publication.
