SALT LAKE CITY ORDINANCE
No. 73 of 2015
(Enacting provisions related to government
transition following an election)
An ordinance enacting Chapter 2.03,Salt Lake City Code,to establish provisions related
to government transition following an election for mayor and/or city council members.
WHEREAS,it is proposed that an ordinance be enacted to establish policies and
procedures to help prepare a newly elected mayor and council members for their duties and
responsibilities prior to formally assuming their offices;and
WHEREAS,such policies and procedures will establish a transition process that is
orderly,assures essential and helpful information is transmitted to newly elected officials,
maximizes institutional knowledge,establishes a strong base of common information to increase
the efficiency and effectiveness of government operations,and protects the investment of
taxpayer funds by maintaining the continuity of government;and
WHEREAS,after holding a duly noticed public meeting to consider this ordinance,the
Salt Lake City Council has determined that adopting this ordinance is in the city's best interests.
NOW,THEREFORE,be it ordained by the City Council of Salt Lake City,Utah:
SECTION 1.Chapter 2.03 of the Salt Lake City Code shall be,and hereby is,enacted as
shown below:
Chapter 2.03
GOVERNMENT TRANSITION FOLLOWING AN ELECTION
2.03.010:PURPOSE:
The purpose of this chapter is to establish policies and procedures to help prepare a newly

elected mayor and council members for their duties and responsibilities prior to formally
assuming their offices.
2.03.020:TRANSITION PERIOD:
For the purpose of this chapter,the"transition period'referenced herein shall mean the
period from the day after the election canvass has been certified by the city board of canvassers
until the day of the oath of office ceremony held on the first Monday in January of the year
following the election.
2.03.030:TRANSITION EXPENSES:
A.In an election year for city elected officers,the city council shall,as part of the annual
city budget process or by a budget amendment as may be necessary,consider appropriating
funds from the general fund balance or another funding source to assist with the cost of transition
to a newly elected mayor and council members.
B.The proposed budget for transition costs shall identify funds that may be used to
accomplish the following:
1.Funding to operate the office of the mayor-elect,if more than fifty(50)percent
of the appropriated annual budget for the mayor's office is spent and unavailable to the
mayor-elect as of the induction date;
2.Funding to provide salaries and benefits for:
a.Council members-elect equivalent to fifty percent(50%)of a current
council member's salary,
b,The mayor-elect equivalent to fifty percent(50%)of the current
mayor's salary,
c.Two(2)staff positions equivalent to fifty percent(50%)of the current
salary of mayor's chief-of-staff and a mayoral assistant,and
d.Benefits for all of the above-named positions at one hundred percent
(100%)of current benefits;
3.Funding for expenses during the transition period,including but not limited to
the following:
a.For the mayor-elect and mayor-elect's staff identified in subsection
2.03.030.13.2:

i. Office space in city hall or another city-owned location within a
reasonable distance from city hall,
ii. Expenses for computer and telephone equipment for use during
the transition period;
iii. Expenses to set up the office of the mayor-elect, once the
mayor takes office; and
b. For council members-elect:
i. Costs associated with providing mobile device to access meeting
and agenda materials;
4. Funding that may be required to allow a person serving in an appointed
position, which is terminated by the mayor-elect, to return to a position previously held
by that person so long as such return is allowed by applicable law and civil service rules;
5. Funding for a portrait of the outgoing mayor;
6. Funding for benefits of appointed employees who are not retained by the
mayor-elect; and
7. Funding to fully cover costs associated with the induction ceremony for newly
elected officials and an event for outgoing officials.
2.03.040: PUBLIC INFORMATION FOR NEWLY ELECTED OFFICIALS:
A. 1. The day following the canvass of the election for mayor and/or council
members by the city board of canvassers, the mayor shall designate an existing
city employee to serve as a transition officer. The transition officer shall notify
current and incoming elected officials of such designation and shall provide the
transition officer's name and contact information to all current and incoming city
elected officials.
2. If such officials are not timely notified that a transition officer has been
designated, the city council shall schedule at their next formal meeting a
discussion on whether to make other arrangements as may be necessary to provide
for an orderly transition.
B. The transition officer shall provide information that is public to the mayor-
elect and council members-elect, including but not limited to, the following:
1. A list of appointed city positions, including:

a.The budget for the appointed positions and associated details,
including but not limited to,salary grade,rate of pay,and contact
information for each incumbent serving in an appointed position,and
b.Identification of appointed positions subject to the advice and
consent of the city council;
2.Contact information for the mayor,mayor-elect,city council members,
city council members-elect,city council executive director,and each department
director;
3.Conflict of interest and ethics rules applicable to elected officials;
4.Complete city budget;
5.Information regarding:
a.The relationship between the city council and the mayor,
including the mayor's administration;
b.The structure and processes of Salt Lake City administrative and
legislative bodies;
c.Formal policies established by the city council;
d.Human resource information and forms necessary to set up the
mayor-elect and council members-elect as city employees;and
e.Any other public information reasonably requested by the
mayor-elect and/or council members-elect.
C.The transition officer shall provide equal and timely access to additional requested
public information and shall facilitate the scheduling of briefings with department directors and
others as deemed appropriate through the mayor or the mayor's chief of staff.
D.The transition officer shall,within seven(7)days after designation,set orientation
and information meetings for the mayor-elect and council members-elect and shall notify current
and incoming elected officials that the orientation process has been initiated.If such meetings are
not timely scheduled,the city council may convene such meetings as the council may determine.
2.03.050:GIFTS AND CONTRIBUTIONS:
The receipt of any gift or political campaign contribution by the mayor-elect and
council members-elect during the transition period or thereafter is subject,respectively,to the

provisions of Chapter 2.44(Conflict of Interest)and Chapter 2.46(Campaign Financing
Disclosure)of the Salt Lake City Code.
SECTION 2.This ordinance shall become effective thirty(30)days after the date of its
first publication.
