074 of 1985 - Relocation of a Portion of Kennedy Drive and Disclaimer FOR 0 85-35 ITFICE SALT LAKE CITY ORDINANCE No. 74 of 1985 (Relocation of a portion of Kennedy Drive and disclaimer) (AN ORDINANCE AUTHORIZING THE RELOCATION OF A PORTION OF KENNEDY DRIVE AT APPROXIMATELY 2745 EAST AND CLOSING ANY REMNANT FOR USE AS A PUBLIC THOROUGHFARE. ) WHEREAS, Kennedy Drive became a dedicated street in March of 1951 with the filing of a Street Dedication Plat in Plat Book L at .page 100; and WHEREAS, after a public meeting on the matter, the City Council of Salt Lake City, Utah finds that it is in the public' s interest to redesign Kennedy Drive which requires relocation and reconstruction of a portion of said street in the vicinity of 2745 East where Kennedy intersects with Oak Hills Way and Crestview Drive ; and WHEREAS, the modified configuration will be dedicated by the City with the platting of the CANYON VIEW PARK SUBDIVISION, which shall be recorded in conjunction herewith; and WHEREAS, the City accepts the dedication of the modified CANYON VIEW PARK SUBDIVISION street and public utility easement configuration as a substitute for said Kennedy Drive and that portion of vacated Michigan Avenue which lies east of Crestview Drive. The City no longer has an interest in maintaining said remnants as a part of the public street system , EXCEPTING for those portions which fall within the streets and public utility i S r ♦ r easements platted on said CANYON VIEW PARK SUBDIVISION; closure of said remnants will not be adverse to the general public' s interest, and closure will not relinquish or terminate the City' s interest in the underlying property, which shall become part of said subdivision without separate documents of transfer. NOW THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1 . The public street known as Kennedy Drive, as it was dedicated by plat recorded at Book L at page 100, has been redesigned for reconstruction. Said redesign requires and the Council hereby authorized the relocation of a portion of said street in the vicinity of a 74S East at its intersection with Oak Hills Way and Crestview Drive. The approved modified street and public utility easement configuration, is attached hereto as Exhibit "A" and incorporated by reference; said Exhibit "A" is the CANYON VIEW PARK SUBDIVISION plat. SECTION 2. That portion of the original Kennedy Drive which does not lie within the said redesigned street, as reflected on Exhibit "A" in the subdivision plat is hereby closed and declared no longer to be needed or available for use by the public as a public thoroughfare subject to the terms hereof. Title to the City' s interests in said remnant are hereby reserved in Salt Lake City Corporation. With the platting of said dedicated subdivision, the City will preserve its dedicated interest in Kennedy Drive and designated utility easements to protect -2- existing and future utility service. The City' s interests in any other portions of the remnant shall merge into the lots. SECTION 3. CONDITIONS. This ordinance after passage shall be published , but shall not be effective, and recorded until the following conditions have been satisfied according to the procedures set forth in Section 4. 1 . The Canyon View Park Subdivision plat and documentation is executed, approved, and submitted for recording concurrent with this ordinance. SECTION 4. EFFECTIVE DATE. After the date of its first publication, this ordinance shall not become effective until recorded with the Recorder of Salt Lake County. However the City Recorder is instructed not to record until the City Attorney, Engineer and Planning Director verify to the Mayor that the conditions have been satisfied. Upon verification, the Mayor may instruct the ordinance be recorded in conjunction with the final platting of the proposed Canyon View Park Subdivision. However, if the foregoing condition is not completed within 12 months from date the ordinance is passed, this ordinance shall be null , void, and of no effect; and thereafter no recording shall be allowed.
