AN ORDINANCE AMENDING SECTION 51 -12-2 OF THE REVISED
ORDINANCES OF SALT LAKE CITY, UTAH, 1965, RELATING TO ZONING AND
FIXING BOUNDARIES OF USE DISTRICTS.
WHEREAS, in response to Petition 400-90 of 1983 requesting a
change of zoning, the City Council of Salt Lake City, Utah has
held public hearings to consider said petition and the recom-
mendation of the Planning Commission that certain property, a
portion of the Glendale Park, located on the south side of 1700
South in the vicinity of 1200 West, Salt Lake City, Utah,
presently zoned Residential "R-2" should be rezoned to a Commer-
cial "C-3A" classification. The Council has taken into
consideration citizen testimony, and planning and demographic
data of the area, and based upon the same, finds that the
proposed rezoning is appropriate in order to encourage appro-
priate development and growth compatibility of recreational
interests with the best interests of the neighborhood and the
development of the city as a whole; and
WHEREFORE, the City Council of Salt Lake City, Utah, hereby
adopts the following amendments to the Use District Provisions of �n

NOW, THEREFORE, be it ordained by the City Council of Salt

SECTION 1 . That the Use District Map, as adopted by Section
51 -12-2 of the Revised Ordinances of Salt Lake City, Utah , 1965,
as amended , 'relatinq to the fixing of boundaries of use
districts, be, and the same hereby is amended as follows:
Sec. 51-12-2 . Boundaries of Use District. That the
following-described parcel of residentially-zoned land in Salt
Lake City, Utah, generally located on the south side of 1700
South, Glendale Park area at approximately 1200 West, currently
zoned Residential "R-2" is hereby rezoned to a Commercial "C-3A"
classification and the Use District Map is amended and changed
accordingly.
A parcel of land located in the West Half of Section
14, Township 1 South, Range 1 West, Salt Lake Base &
Meridian, State of Utah, described as follows :

SECTION 2. CONDITIONS SUBSEQUENT. This ordinance, after
passage, shall be published, but shall not become effective until
recorded as set forth in Section 3 concurrently with the execu-
tion of anticipated documents such as leases dealing with the
establishment of a proposed wild wave aqua theme amusement park
and the issuance of building permits therefor. Before executing
any final documents such as :leases, etc. . and/or issuing any
building permits, the Council shall be advised of the proposed
terms and the proposed design of the final project to determine
if it is in substantial compliance with the following
requirements:
1 . That any lease or other agreement ensures that the .1
property will only be used for the type of- water amusement park GO
for which the design has been approved by the City Council and if

such fails, the City Council will then support the request of
to
rezoning to protect the neighborhood from commercial development.

2. That the facility and conditions governing its opera-
tions be designed to:
a. Reduce noise and to ensure noise ordinances are
observed;
b. Adequately handle off-street parking and to
discourage the, same from spilling off of the site and onto
1700 South or into adjoining areas;
C. Provide adequate security facilities;
d. Prohibit the sale or presence of alcoholic
beverages on the premises and ensure that the area is
treated in the same manner as other City parks;
e. Provide maintenance by the developer of the
property and improvements in an orderly and litter-free
condition;
f. Require selection of a developer committed and
obligated to work with neighborhood families to ensure
effective use of the theme park as a neighborhood recrea-
tional park;
g. Provide the neighborhood with a meaningful oppor-
tunity to be involved with the design and negotiations
dealing with the operation of the facilities.
SECTION 3. This ordinance, after the date of its first Cn

Recorder of Salt Lake County as designated in Section 2 above.

If the foregoing conditions specified in Section 2, including
