WHEREAS, the City Council of Salt Lake City, Utah, finds after public hearing that the City's interest in vacating a railroad crossing at approximately 4150 West 860 South, described below is not necessary for use by the public as a railroad crossing and that general public's interest. NOW, THEREFORE, be it ordained by the City Council of Salt LakE City, Utah: �{b SECTION 1. That a portion of a railroad crossing at approximately 4150 West 860 South, which is the subject of Petition No. 400-92-49 and which is more particularly described below, be, and the same hereby is, VACATED and declared no longer to be needed or available for use as a railroad crossing. Said railroad crossing is more particularly described as follows: BEGINNING at a point that is S 00° 18' 17" E along the Quarter Section line 1035.03 feet and N 80° 48' 50" E along the North side of a railroad R/W 1573.74 feet from the North 1/4 corner of Section 7, T1S, R1W, of the S.L.B. & M. a Salt Lake County monument. The basis of bearing being S 00° 18' 17" E between the North 1/4 corner of Section 7 and a center of section corner, also being a Salt Lake County monument; thence N 80° 48' 50" E 102.83 feet along the North side of the railroad R/W; thence S 51° 43' 17" W 205.67 feet crossing the railroad R/W to the South line of same R/W; thence S 80° 48' 50" W 102.83 feet along the South line of the railroad R/W; thence N 51° 43' 17" E 205.67 feet crossing the railroad R/W to the point of beginning, containing 0.2361 acres. SECTION 2. RESERVATIONS AND DISCLAIMERS. The above vacation is expressly made SUBJECT TO all existing rights -of -way and easements of all public utilities of any and every description now located on and under or over the confines of the property and also SUBJECT TO the rights of entry thereon for the purposes of maintaining, altering, repairing, removing or rerouting said utilities, including the City's water and sewer facilities, and all of them. Said vacation is also SUBJECT TO any existing rights -of - way or easements of private third parties. SECTION 3. CONDITIONS. This ordinance shall not become effective until the Mayor certifies that the railroad crossing vacated by this ordinance has been replaced by the completion of a new railroad crossing on 4400 West at approximately 870 South. SECTION 4. EFFECTIVE DATE. This ordinance shall become effective on the date of its first publication and shall be recorded with the Salt Lake County Recorder. The City Recorder is instructed not to publish or record this ordinance until the Mayor has certified that the condition required by Section 3 above has been met. In the event that such condition has not been met within one year from the date of this ordinance the Mayor may extend the -2- time for the conditions fulfillment by an additional year. In the event that the condition has not been fulfilled within the first year or any extension this ordinance shall be null and void and shall not be published or recorded.
