008 of 1986 - Administrative Organization Amendment 0 86-1 APPROVED FOR PRINTING 0 86-3 R11REWS SALT LAKE CITY ORDINANCE No . 8 of 1986 ( Administrative organization) AN ORDINANCE AMENDING CHAPTER 3 OF TITLE 24 OF THE REVISED ORDINANCES OF SALT LAKE CITY, UTAH, 1965 AS AMENDED, RELATING TO ADMINISTRATIVE ORGANIZATION. Be it ordained by-the City Council of Salt Lake City , Utah: SECTION 1. That Chapter 3 of Title 24 of the Revised Ordinances of Salt Lake City , Utah, 1965, as amended , relating to administrative organization , be , and the same hereby is amended as follows : Chapter 3 ADMINISTRATIVE ORGANIZATION Section : 24-3-1. Administrative Organization. 24-3-2. Department of Administrative Services . 24-3-3. Department of Airports and Airport Authority. 24-3-4. Office of City Attorney. 24-3-5. Department of Development Services. 24-3-6. Department of Finance and Administrative Services . 2 4-3-7. Fire Department. 24-3-8. Parks Department . 24-3-9. Police Department. 24-3-10. Department of Public Utilities . 24-3-11. Department of Public Works. Sec. 24-3-1. Administrative Organization. Subject to the limitations and requirements of applicable budget and appropriations , the City' s administrative organization shall consist of operating departments, offices and divisions or bureaus. Each department shall be identified and have the duties, functions and responsibilities as hereafter generally designated and as assigned by the Mayor. Each shall be organized into such divisions as may be determined by the Mayor to be appropriate to carry out its functions. Sec. 2 4-3-2. De par tmen t of Administrative Services. (1 ) Functions. The Department of Administrative Services shall have charge of and be responsible for coordinating and supervising the following offices and operations: animal control; fleet and motor vehicle management , repair and services; data processing ; building facilities services, maintenance and repair; and city recorder and recording all public documents of the City, not statutorily given to the city engineer or other officer ; (2 ) City Recorder. The City Recorder shall be assigned to the Department of Administrative Services and be under the administrative direction of the director ; however , the said Recorder shall be responsible to the City Council which shall have equal and independent access for services with respect to legislative functions. The City Recorder shall keep: the corporate seal , the official papers and records of the City , as required by law ; a record of the proceedings of the City, as required by law; and shall attest legal documents of the City and do those other matters prescribed by law. Sec. 24-3-3. Department of Airports and Airport Authority. ( 1) Functions. The department shall have charge of and be -2- responsible for the planning , design, construction, operation, maintenance , administration and management of all airport properties and attendant facilities under jurisdiction of Salt Lake City , including any required satellite operating or support facilities. ( 2 ) Airport Authority Board . The Airport Authority created under and functioning pursuant to the provisions of chapter 20 of title 2 of these Revised Ordinances shall provide citizen assistance and direction to the Director of Airports and shall coordinate, report and receive direction on administrative and executive functions from the Mayor. It shall coordinate and report legislative matters through the Mayor to the City Council . Sec. 24-3-4. Office of City Attorney. ( 1) Functions. The City Attorney shall be the chief legal officer of the City and shall be responsible to the Mayor and City Council for the proper administration of the legal affairs of the Executive and Legislative branches of City government . The executive and legislative branches of government shall enjoy equal and independent access to the services of the Office of the City Attorney with reference to their respective functions and duties. It shall be the responsibility of the City Attorney to administer the Office of the City Attorney in a manner which will enable the Mayor and City Council to fulfill their respective duties in a timely fashion. The foregoing notwithstanding , the City Attorney shall not -3- in any instance, either personally, or by his deputies, act as both prosecutor and advocate before ( and at the same time advisor to) any board , commission, agency , officer , official , or body of the City. In cases where such a conflict shall arise , special counsel may be employed who shall not be subject to the control or direction of the City Attorney in such matter , and who shall provide the legal service to or before such board , commission, agency, officer , official , or body. ( 2 ) Separate Executive or Legislative Counsel . Nothing herein shall be construed to prohibit either the City Council or Mayor from retaining separate counsel from appropriated funds, as either may fran time to time deem appropriate . Sec . 24-3-5. Department of Development Services. ( 1) Functions. The department have charge of and be responsible for: ( a) the development of the City' s master land use and public facility plan ; and ( b) the development , administration and enforcement of all attendant laws , codes, ordinances and relative regulations ( including but not limited to future land use plans, zoning ordinances, subdivision regulations , and building and housing codes) , intended to serve the implementation of said plans. Sec. 24-3-6. Department of Finance . (1) Functions. The Department of Finance shall have charge of and be responsible for financial services required for City operations. Included in these services shall be purchasing , -4- property acquisition and disposition, cash management and investment , accounting , payroll , financial reporting , revenue collections and disbursements and licensing . (2 ) City Auditor. The Director of the Department or the Mayor' s designee shall be the City Auditor, within the meaning of the Uniform Fiscal Procedures Act of the State . ( 3 ) City Treasurer. The functions of City Treasurer shall be assigned to the department under the administrative direction of the Director. The City Treasurer shall : ( a) supervise the collection of all taxes , assessments , fines , forfeitures , service charges, intergovernmental revenue , licenses, fees, and other revenues of the City, as provided for by applicable laws and ordinances; ( b) be responsible for the disposition of City revenues ; ( c) provide for the investment of idle cash; ( d) make all disbursements of funds of the City, subject to budget appropriations ; ( e) keep an accurate and detailed accounting of all transactions, receipts, disbursements and other matters within the Treasurer' s charge as provided in the Uniform Fiscal Procedures Act and as the City may by ordinance or resolution direct ; ( f) maintain legally required balances in sinking fund accounts and special improvement district guarantee fund accounts; ( g) record the bond of the City Recorder as required by Section 10-3-825 Utah Code Ann. or any successor statutes; and ( h) execute all checks of the City consistent with State law. Sec. 24-3-7. Fire Department. -5- ( 1) Functions. The Fire Department shall be responsible throughout the City for the protection of life and property from damage or loss due to fire, through measures including , but not limited to: ( a) the development and administration of public education and fire prevention programs ; (b) fire safety; ( c) fire and safety inspections of buildings and proposed building plans ; ( d) fire rescue and emergency services; ( e) fire combat; and ( f) post investigation of fires for possible arson . ( 2 ) Duties. The Chief of the Fire Department shall be the appointing power and have the command over all the officers , members and employees of the department. It shall be the duty of the Chief of the Fire Department , subject to the approval of the Mayor, to make and adopt such rules and regulations for the administration and operation of the department as in his/her judgment shall be necessary for the good of the service. Sec. 24-3-8. Parks Department. ( 1) Functions. The Parks Department shall have charge of and be responsible for: ( a) the general supervision , maintenance, upkeep and control of the City' s parks , playgrounds , athletic fields , golf courses , pools , and other recreational areas and facilities; ( b) the City' s Cemetery; (c) recreational activities , cultural and arts programs of the City ; and ( d) maintenance and upkeep of shade trees and other plantings , together with the abatement of weeds and other noxious vegetation in the City' s public-ways or on other public property. -6- Sec . 24-3-9. Police Department. ( 1) Functions. The Police Department by and through its sworn officers, shall be responsible for preserving the public peace , preventing crime , detecting and arrest criminal offenders , protecting the rights of persons and property, regulating and controlling motorized and pedestrian traffic , training sworn personnel , and providing and maintaining police records and communications systems. ( 2 ) Duties. The Chief of the Police Department shall be the appointing power and have command over all the officers , members and employees in the department. It shall be the duty of the Chief , subject to the approval of the Mayor , to make and adopt such rules and regulations for the operation and administration of the department, as in the Chief' s judgment , shall be necessary for the good of the service. Sec. 2 4-3-1 0. Department of Public Utilities . (1) Functions. The Department of Public Utilities shall have charge of and be responsible for: ( a) the acquisition , transportation, storage, treatment, and distribution of all irrigation , raw and potable water for the City and its designated service areas, including but not limited to : ( i) all farms and watershed lands , so far as the same affect the water supply of the City; ( ii) all water sources from which the danestic supply is or may be taken; ( iii) all reservoirs , conduits , tanks , water mains, City fire hydrants located within Salt Lake City and -7- appurtenant equipment and properties; ( iv) irrigation gates, dams , flumes , ditches and reservoirs necessary for the proper control and distribution of irrigation water within the corporate City limits or for which the City is acting as distributing agent; and ( b) keeping records of the location of all principal gates , dams , flumes , ditches , canals and reservoirs and water rights owned by the City, which records shall show the nature of construction , the length and capacity of the principal canals and ditches, and such other information as may be necessary to enable a proper understanding of the City' s rights from an examination thereof and ( c) the collection, treatment, and disposal of all wastewater ( sewage) generated within the City or its designated service areas. ( 2 ) Water Boards, Miscellaneous. The Director of Public Utilities shall represent the City, if consistent with law , on the various water or sewer boards, commissions, and similar administering bodies on which the City is entitled to sit by virtue of State law, contractual agreement or by-laws of said bodies . Sec . 24-3-11. Department of Public Works. (1) Functions: The Department of Public Works shall have charge of and be responsible for: ( a) the supervision of the design and construction of the public works of the City; ( b) the operation and maintenance of streets, parkways , sidewalks , drainageways , traffic control devices , street lighting and -8- similar public-ways and facilities; ( c) other property or works and the supervision and coordination and all construction work or alterations carried out within the public-ways of the City; (d) for the collection and disposal of all solid waste generated within the City as provided for in City ordinances; and ( e) maintenance and repair of all ditches , flumes , culverts and drains or irrigation systems operated within City streets or rights-of-way. ( 2 ) City Engineer. The position of City Engineer shall be assigned to the Department of Public Works , under the administrative direction of the Director of Public Works . The City Engineer shall be a registered professional engineer of the State of Utah and shall be responsible for the review , supervision and acceptance of all engineering and architectural design, and construction work required by or for the City, except as assigned in these ordinances to other departments or offices of the City ; the coordination and supervision of all construction work done within the public rights-of-way of the City ; and the records of public improvements as prescribed by State statute . Said duties may be delegated as deemed prudent and appropriate ; such delegation may include the Utilities Department ( for recording and maintaining engineering records relating to the water and sewer systems and its engineering functions) and the Department of Airports . -9- SECTION 2.
