HomeMy WebLinkAbout085 of 1995 - Closing a portion of an alley between Paxton Avenue and Lucy Avenue west of 300 West pursuant to Pet0 95-1 P 95-368 SALT LAKE CITY ORDINANCE No. 85 of 1995 (Closing a portion of an alley between Paxton Avenue and Lucy Avenue west of 300 West pursuant to Petition Nos. 400-95-45 and 400-95-62) AN ORDINANCE CLOSING A PORTION OF AN ALLEY BETWEEN PAXTON AVENUE AND LUCY AVENUE WEST OF 300 WEST, PURSUANT TO PETITION NOS. 400-95-45 and 400-95-62. WHEREAS, the City Council of Salt Lake City, Utah, finds after public hearing that the City's interest in the public alley described below is not necessary for use by the public as an alley and that closure of said alley will not be adverse to the general public's interest nor divest the City of title to the property without subsequent documents of transfer. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That a portion of an alley between Paxton Avenue and Lucy Avenue west of 300 West, which is the subject of Petition Nos. 400-95-45 and 400-95-62, and which is more particularly described below, be, and the same hereby is, CLOSED and declared no longer to be needed or available for use as a 1 NO public alley, with the title remaining with the City until subsequent sale for market value: Said alley is more particularly described as follows: Commencing at the northeast corner of Lot 48, Block 4; Davis, Sharp and Stringer's Subdivision; located in the southwest quarter of Section 13, T.1S, R.1W, S.L.B.&M.; thence south 279.5 feet to the southeast corner of Lot 2; thence east 12.3 feet to the southwest corner of Lot 1; thence north 279.5 feet to the northwest corner of Lot 49; thence west 12.3 feet to the point of beginning. SECTION 2. RESERVATION AND DISCLAIMERS. The above closure is expressly made SUBJECT TO all existing rights -of -way and easements of all public utilities of any and every description now located on and under or over the confines of the property and also SUBJECT TO the rights of entry thereon for the purposes of maintaining, altering, repairing, removing or rerouting said utilities, including the City's water and sewer facilities, and all of them. Said closure is also SUBJECT TO any existing rights -of -way or easements of private third parties. SECTION 3. EFFECTIVE DATE.
