(Closing a portion and vacating a portion
of an alley located between Indiana Avenue
and 900 South and between 1400 West and
Navajo Street, pursuant to Petition No. 400-96-48)
AN ORDINANCE CLOSING A PORTION AND VACATING A PORTION
OF AN ALLEY, LOCATED BETWEEN INDIANA AVENUE AND 900 SOUTH
AND BETWEEN 1400 WEST AND NAVAJO STREET, PURSUANT TO
PETITION NO. 400-96-48.
WHEREAS, the City Council of Salt Lake City, Utah,
finds after public hearing that the City's interest in the
portion of the alley described below is not necessary for
use by the public as an alley and that closure and/or
vacation of the portion of said alley will not be adverse to
the general public's interest; and
WHEREAS, the title to the closed portion of said alley
shall remain with the City until sale for fair market value;
NOW, THEREFORE, be it ordained by the City Council of
Salt Lake City, Utah:
SECTION 1. That a portion of an alley located between
Indiana Avenue and 900 South and between 1400 West and
Navajo Street, which is the subject of Petition No. 400-96-
48, and which is more particularly described below, be, and
the same hereby is, closed and/or vacated and declared no
longer to be needed or available for use as an alley.
The portion of said alley to be closed is more
particularly described as follows:
Beginning at the southeast corner of Lot 1, Block 1,
First Burlington Addition to Glendale Park, a
subdivision located in the northeast quarter of Section
10, Township 1 South, Range 1 West, Salt Lake Base and
Meridian; thence west 103 feet to the southwest corner
of Lot 4 of said subdivision; thence south 5.5 feet to
the centerline of an alley running east/west; thence
east 103 feet along the centerline of said alley;
thence north 5.5 feet to the point of beginning.
The portions of said alley to be vacated are more
particularly described as follows:
Beginning at the southwest corner of Lot 19, Block 1,
First Burlington Addition to Glendale Park, a
subdivision located in the northeast quarter of Section
10, Township 1 South, Range 1 West, Salt Lake Base and
Meridian; thence north 47 feet to the northwest corner
of Lot 20 of said subdivision; thence west 14 feet to
the northwest corner of Lot 17 of said subdivision;
thence south 47 feet to the southeast corner of Lot 18
of said subdivision; thence east 14 feet to the point
of beginning.
Beginning at a point 146 feet west from the southeast
corner of Lot 1, Block 1, First Burlington Addition to
Glendale Park, a subdivision located in the northeast
quarter of Section 10, Township 1 South, Range 1 West,

Salt Lake Base and Meridian; thence south 36 feet to a
point of tangency, this point is also the southwest
corner of Lot 24 of said subdivision; thence
northeasterly 39.27 feet along the arc of a 25 feet
radius curve to the right; thence east 121 feet to the
northeast corner of Lot 24 of said subdivision; thence
north 5.5 feet to the centerline of an alley running
east/west; thence west 103 feet along the centerline of
said alley; thence north 5.5 feet to the southeast
corner of Lot 5 of said subdivision; thence west 43
feet to the point of beginning.
SECTION 2. RESERVATIONS AND DISCLAIMERS. The above
closure and vacation is expressly made SUBJECT TO all
existing rights -of -way and easements of all public utilities
of any and every description now located on and under or
over the confines of the property and also SUBJECT TO the
rights of entry thereon for the purposes of maintaining,
altering, repairing, removing or rerouting said utilities,
including the City's water and sewer facilities. Said
closure and vacation is also SUBJECT TO any existing rights -
of -way or easements of private third parties.
SECTION 3. TRANSFER OF TITLE. Title to the vacated
portion of this property is hereby transferred from the City
to all abutting property owners on a pro rata basis.
SECTION 4. EFFECTIVE DATE. This ordinance shall
become effective on the date of its first publication and
shall be recorded with the Salt Lake County Recorder.
