SALT LAKE CITY ORDINANCE No. 86 of 1996 (Rezoning property located between Utah and Cheyenne Streets at approximately 1400 South from Residential to Special Residential, pursuant to Petition No. 400-96-58) AN ORDINANCE REZONING PROPERTY LOCATED BETWEEN UTAH AND CHEYENNE STREETS AT APPROXIMATELY 1400 SOUTH FROM RESIDENTIAL (R-1/7000) TO SPECIAL RESIDENTIAL (SR-3), PURSUANT TO PETITION NO. 400-96-58. WHEREAS, in response to rezoning Petition No. 400-96- 58, the City Council of Salt Lake City, Utah has held public hearings before its own body and before the Planning Commission, and has taken into consideration citizen testimony, filing and demographic details of the area, a long range general plan for the City, and any local master plan as part of its deliberation. Pursuant to these deliberations the Council has concluded that the proposed change of zoning for the property located between Utah and Cheyenne Streets at approximately 1400 South, more particularly described below, is appropriate for the development of the community in that area; NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That the property located between Utah and Cheyenne Streets at approximately 1400 South, which is the subject of Petition No. 400-96-58, and which is more particularly described below, shall be and hereby is rezoned from Residential (R-1/7000) to Special Residential (SR-3). This real property is more particularly described as follows: Beginning at the northwest corner of Lot 10, Utah Southern Addition, a subdivision located in the northeast quarter of Section 15, Township 1 South, Range 1 West, Salt Lake Base and Meridian, running thence south 437.8 feet; thence east 453.5 feet; thence north 68.75 feet; thence west 12.5 feet; thence north 68.75 feet; thence east 146 feet; thence north 56.0 feet; thence west 103.0 feet; thence north 68.0 feet; thence west 164 feet; thence north 176.0 feet; thence west 320 feet to the point of beginning. SECTION 2. ZONING MAP. The Salt Lake City Zoning Map, as adopted by the Salt Lake City Code, relating to the fixing of boundaries of zoning districts, shall be and 2 hereby is amended to reflect the change in zoning described above. SECTION 3. CONDITIONS. This ordinance shall not become effective until the Mayor has certified that the developer has submitted a recordable condominium plat that is consistent with the site plan approved by the Planning Commission. SECTION 4. EFFECTIVE DATE. This ordinance shall take effect immediately upon the date of its being first published and recorded with the Salt Lake County Recorder. The City Recorder is instructed not to record or publish this ordinance until the Mayor has certified that the condition specified in Section 2 above has been met. In the event that the condition has not been met within one year from the date of this ordinance the Mayor may extend the time for performance for one additional year. If the condition has not been met within the time permitted by this ordinance the City Recorder is instructed to not record or publish the ordinance, which shall become null, void and of no effect.
