089 of 1986 - Vacating Alley under Petition No. 400-446 . 0 86-1 P 8 6-286 0 SALT LAKE CITY ORDINANCE No. 89 of 1986 (Vacating an east-vest alley running between McClelland Street part of the way to Tenth East between Ninth South and Belmont Avenue located in Salt Lake City, Utah, pursuant to Petition No. 400-446) AN ORDINANCE VACATING AN ALLEY LOCATED IN SALT LAKE CITY, UTAH, AND REQUIRING CERTAIN CONDITIONS. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That alley located in Salt Lake City, Utah, be and the same hereby is VACATED and declared no longer to be public property for use as a street, avenue, alley or pedestrian way. r SECTION 2. Said alley is more particularly described as follows: s 4 Beginning at the Northwest corner of Lot 16, Gilmer Place Subdivision, '' Part of Lots 12 and 13, Block 17, 5 Acre Plat A, Big Field Survey thence East 153 feet, thence North 16 feet, thence West 153 feet,thence South 16 feet to the point of beginning. RESERVATIONS. Said vacation is expressly made: SUBJECT TO all existing rights of way and easements of all public utilities of any and every description now located on, in, under or over the confines of the above-described real property. ALSO SUBJECT TO the rights of entry thereon for the purposes of obtaining, altering,replacing, removing,repairing or rerouting said utilities and all of them. Said vacation is also SUBJECT TO any existing rights of way or easements of private third parties. SECTION 3. CONDITIONS. This ordinance, after passage, shall be published but shall not become effective until the following condition has been satisfied: Petitioner shall pay to the City the cost of having a "Dead-End" sign posted on the Belmont Avenue entrance to the alley and further shall remove the driveway access to the alley on McClelland Street and install new curb, gutter and landscaping of the parking strip as approved by the City Engineering Department, and any fence or other structure on the alley portion shall be brought into compliance with applicable City ordinances. Alternatively, if, before the expiration of the Ordinance, petitioner gains ownership of the entire alley and determines to use it for a driveway, the driveway shall be hard-surfaced back to a point where a detached garage would be allowed. SECTION 4. EFFECTIVE DATE: This Ordinance shall not become effective until recorded with the Office of the Salt Lake County Recorder. However, the Salt Lake City Recorder is instructed not to record this Ordinance until the Mayor verifies that the conditions have been satisfied. If the foregoing conditions have not been satisfied within one year from the date of passage, this Ordinance shall be null, void and of no effect and shall not be recorded.
