AN ORDINANCE EXTENDING THE CORPORATE LIMITS OF SALT LAKE
CITY BY ANNEXING THE "2100 NORTH PROPERTIES PARTNERSHIP ANNEX",
ZONING THE SAME COMMERCIAL "C-3A" AND AGRICULTURAL "A-1" BY
AMENDING THE USE DISTRICT MAP ADOPTED BY SECTION 51-12-2 SUBJECT
TO THE APPLICABLE AIRPORT ZONING MAP ADOPTED BY SECTION 51-11-4;
AND PROVIDING FOR AN ANNEXATION AGREEMENT, AND AVIGATION
EASEMENT, INCORPORATED BY REFERENCE.
WHEREAS, there has been filed with the City Recorder of Salt
Lake City, Utah, Petition No. 412 of 1980, together with a plat
showing a tract of land proposed for annexation, hereafter known
as the "2100 North Properties Partnership Annex", requesting that
said tract of contiguous land, hereinbelow described, be taken
within the limits of Salt Lake City Corporation for purposes of
development; and
WHEREAS, this Petition is signed by a majority of the owners
of the real property and the owners of more than one-third in
value of all the real property included therein, as shown in the
last assessment rolls; and
WHEREAS, the petitioners have caused an accurate plat or map
to be made and certified to by a competent, licensed land
surveyor and approved by the City Engineer, which shall be filed
with the City and County Recorders; and
WHEREAS, the City Council of Salt Lake City, Utah, on or
about the 24th day of February, 1981, passed Resolution No. 17 of
1981 accepting the Millard Annexation, now to be known as the
2100 North Properties Partnership Annex petition for purposes of
hearing and review; and

WHEREAS, the City Council of Salt Lake City, Utah, after
examining the Petition of said owners regarding said tract of

land, having said Petition reviewed by various departments of the -

City, and having considered the circumstances thereof at a O

publicly-advertised hearing held March 31, 1981, and said Council
finding said proposed annexation is in keeping with the City's
Master Policy Declaration governing annexations, being located in
Study Area No. 1 of said Policy Declaration as adopted on June
20, 1979, and having been voted on by a nearly unanimous vote of
all the City Council members favoring said annexation; and
WHEREAS, no objection or contest of said annexation or the
Policy Declaration of proposed annexation has been filed as
required by law; and
WHEREAS, the proposed annexation is conditional, being based
on certain conditions and requirements forming the consideration
for this ordinance which have been reduced to writing in an
Annexation Agreement and Avigation Easement. Said Agreement and
Easement which are adopted herein and incorporated by reference,
sets forth conditions, requirements and obligations of owners
which become conditions subsequent to this act and conditions
precedent to govern development of the tract, notwithstanding
annexation. Said Annexation Agreement, marked Exhibit "1" and
Avigation Easement, marked Exhibit "2" are hereby incorporated by
reference as a portion of the terms and conditions of this
ordinance.
NOW, THEREFORE, be it ordained by the City Council of Salt
Lake City, Utah:
SECTION 1. Area. That the City limits of Salt Lake City,
Utah, be, and the same herein are, enlarged and extended so as to
include the following described tract of land of approximately
117 acres situated in the vicinity of 2100 North and 2200 West in
Salt Lake County, Utah:
Beginning at the South 1/4 corner Section 16, TIN,
R1W, SLB&M and thence running West 660 feet along o
the section line; thence North 2640 feet more or
less to the 1/4 section line of said Section 16;
thence East 1947 feet more or less along said Oak.

quarter Section line to the West line of 2200 West
Street; thence South 2607 feet more or less along
the West line of 2200 West Street to the North
line of 2100 North Street; thence West 1287 feet ►+
along the North line of 2100 North Street to the a

SECTION 2. "Basic Use District" Zoning. Be it further
ordained and declared that the property described in Section 1
above, be, and the same hereby is, zoned to following use
district classifications:
Commercial "C-3A". That area of 67.15 acres approximately
situated between 2100-2400 North from 2200 to 2340 West, more
particularly described as follows:
Beginning at a point 33 feet North and 165 feet Fast of
the South 1/4 corner of Section 16, T. 1 N., R. 1 W.,
Salt Lake Base and Meridian; running thence North 2607
feet; thence East 1122 feet to the west line of 2200
West Street; thence South 2607 feet along said line to
the north line of 2100 North Street; thence West 1122
feet along said line to the point of beginning.
Contains 67. 15 acres, more or less.
Agricultural "A-1". That area of 49.875 acres approximately
situated between 2100 - 2400 North from 2340 West to 2440 West,
more particularly described as follows:
Beainning at the South 1/4 corner of Section 16, T. 1
N., R. 1 W., Salt Lake Base and Meridian; and running
thence West 660 feet along the south line of said
Section 16; thence North 2640 feet; thence East 825
feet; thence South 2607 feet to the north line of 2100
North Street; thence West 165 feet along said line to
the quarter section line; thence South 33 feet to the
point of beginning. Contains 49.875 acres, more or
less. .
The Use District Map, as adopted by Section 51-12-2,
Reviseed Ordinances of Salt Lake City, Utah, 1965, as amended,
relating to the fixing of boundaries of Use Districts, be, and
the same hereby is amended by the addition of the above-described
property zoned respectively to the Commercial "C-3A" and
Agricultural "A-l" use district classifications as set forth
above in this Section 2.
SECTION 3. Airport Overlay Zoning. Be it further ordained
and declared that the tract of land described in Section 1, is
located within the boundaries of the Airport Zoning Map $

heretofore adopted by Section 51-11-4 of the Revised Ordinances C6n

of Salt Lake City, Utah, 1965, as amended, relating to the 0
establishment of various approved zones of the Salt Lake City

International Airport. Any portion of the property described in �U

Section 1 falling within the boundaries of said airport zoning
map is hereby declared to be subject to the provisions of the
Airport Overlay Zone District and is hereby governed by the
applicable regulations found in Chapter 11 of Title 51 of the
Revised Ordinances of Salt Lake City, Utah, 1965, as amended.
SECTION 4. General Jurisdiction. Be it further ordained
and declared that said tract of land described in Section 1,
including all of the property within the annexation, shall
henceforth be within the corporate limits of Salt Lake City
Corporation. Said tract of land shall be zoned respectively to
the Commercial "C-3A" and Agricultural "A-l" base Use Districts
and shall be subject to the regulations of the Airport Overlay
zone provisions as respectively provided in Sections 2 and 3.
All ordinances, jurisdictions, rules and obligations of or
pertaining to Salt Lake City Corporation are extended over and
made applicable and pertinent to said tract of land; and the
streets, blocks, alleys and ways of said tract shall be
controlled and governed by the ordinances, rules and regulations
of said City in that behalf. The monuments of the City Engineer
shall thenceforth be taken therein as the centers of locations
and distances. Said tract shall be further governed by the
Annexation Agreement and Avigation Easement which are hereby
incorporated into this ordinance by reference.
SECTION 5. Annexation Agreement and Avigation Easement.
The annexation of said tract descibed in Section 1 above is
granted on a condition subsequent that prior to or concurrent
with the adoption of this ordinance but prior to the publication
and recording thereof, the Annexation Agreement and Avigation
Easement prepared by the City Attorney as reflected in the

proposed documents (attached as Exhibits "l" and "2") and N

incorporated herein by reference, bearing the signatures of

property owners within said tract, shall be accepted and executed
by the Mayor of Salt Lake City. The agreement and easement

setting forth requirements for development of said tract are

incorporated by reference and constitute the consideration for
the annexation. They reduce to writing representations and
requirements stipulated to by owners to govern and accommodate
future commercial development upon the tract of land which is now
basically devoted to agricultural uses.
The execution of the Annexation Agreement and Avigation
Easement by property owners is a condition precedent to passage
of this ordinance. Said agreement shall govern future
development. No permits or approvals will be granted, no
services provided, unless owners are in compliance with the terms
of the Agreement and Easement.
SECTION 6. Transmittal. Upon the passage of this
ordinance, the City Recorder shall forward this ordinance
concurrently with the Annexation Agreement and Avigation Easement
executed by property owners and final plat to the Mayor for
acceptance and execution. After the Mayor's signature on the
Agreement this ordinance may thereafter be effective upon
publication. After publication the City Recorder is directed to
file with the County Recorder of Salt Lake County the final map
or plat above mentioned, duly certified and acknowledged,. a
certified copy of this ordinance and the original Annexation
Agreement and Avigation Easement.
SECTION 7. Effective Date. This ordinance shall take
effect upon its first publication, provided, however, no
publication may occur before proper execution of the Annexation
Agreement, Avigation Easement and final plat by the Mayor.
