103 of 1982 - Annexation Petitions Northpoint #2, #3, #4 2, K P 82-312 through 316 RESOLUTION NO. 103 OF 1982 A Resolution Accepting the North Quadrant Annexation Petitions including No. 94-82 (Northpoint #2 by Gossner-Sheffield) No. 180-82 (Northpoint #3 LDS Church), No. 203-82 (Northpoint #4 LDS Church), No. 277-82 (Bothwell/Swaner) and 288-82 (Gillmor/Peck) for Purpose of City Council Review WHEREAS, Salt Lake City has received five individual petitions for the annexation of approximately 10,079 acres of unincorporated territory lying in the northwest quadrant of Salt Lake County, including: Petition 94-82 (Northpoint #2, Gossner-Sheffield submitted by Stephen D. Swindle, Esq. for annexation of approximately 1,490 acres in Sections 2, 3, 4, 5, 9, 10 and 11 of VS R2W, SLB&M. These irregularly shaped parcels of land are situated in the vicinity of 6400-8400 West and 0 to 700 South. The proposed zoning is to an Industrial "M-1A" use district classification. Petition 180-82 (Northpoint #3)--submitted by the investment department of the Corporation of the President of the Church of Jesus Christ of Latter-day Saints for annexation of approximately 43 acres in Section 11, VS, R2W, SLB&M and includes land situated in the vicinity of 6000-6200 West from 700 South, south to the north line of the Western Pacific right of way. The proposed zoning is to an Industrial "M-1A" use district classification. Petition 203-82 (Northpoint #4)--submitted by the Corporation of the President of the Church of Jesus Christ of Latter-day Saints for annexation of approxi- mately 2,080 acres in Sections 16, 21, 22, 27 and 28, TIN R2W, SLB&M. It includes an irregularly-shaped parcel in the general vicinity of 700-3200 North from 6600-8000 West. The proposed zoning is to an Agricultural "A-1" holding use district classifica- tion. Petition 277-82 (Bothwell/Swaner)--submitted by NIELSON & SENIOR, attorneys, for annexation of approximately 3,006 acres in Sections 17, 20, 29, 32 and 33, T1N, R2W, SLB&M. It includes an irregularly- shaped parcel generally situated in the vicinity of approximately 7400-8800 West from 0 South (south of I-80) to approximately 3200 North. The proposed zoning is for an Agricultural "A-1" holding use district classification. Petition 288-82 (Gillmor-Peck)--submitted by C. Frank Gillmor and Tom Peck, et al., for annexation of approximately 3460 acres in Sections 9, 14, 15, 16, 21, 22, 23, 25, 26, and 27 TIN R2W SLB&M. It includes an irregularly-shaped parcel generally situated in the vicinity of 700-3400 North from 4800-7600 West. The proposed zoning is for Agricultural "A-1", with the exception of the eastern one-half of Section 25, which is proposed for Industrial "M-1A" zoning. WHEREAS, petitioners of each petition appear to constitute a majority of the owners of real property within the area proposed for annexation by the respective petition, as shown by the last assessment rolls of Salt Lake County; and WHEREAS, said petitioners of each petition also appear to constitute the owners of at least one-third in value of the real property in the subject area described in each petition, as shown by the assessment rolls; and WHEREAS, petitioners have submitted a map of the territory within each petition proposed for annexation to the City; and WHEREAS, the territory within each petition lies or will lie contiguous to the corporate limits of Salt Lake City, and is individually and collectively within Study Area No. 1, projected for municipal expansion under Salt Lake City's Master Policy Declaration, as adopted June 20, 1979. NOW, THEREFORE, BE IT RESOLVED by the City Council of Salt Lake City, Utah, that it does hereby: 1. Accept the petitioners' petition Nos. 94-82, 180-82, 203-82, 277-82, and 288-82 for annexation of land in the northwest quadrant, for the purpose of considering said annexa- tions for the expansion of the City's municipal limits by way of reviewing existing policy declarations relating to said Study Area No. 1, as previously adopted by the City. For purposes of review, each petition shall be considered individually and collectively and for scheduling purposes shall be scheduled and processed together concurrently for review purposes; and 2. Direct the City Recorder to set a public hearing before the City Council to review the proposed annexation petitions, the proposed zoning classifications as recommended by the Planning Commission, as set forth above, and the implementation of the Master Policy Declaration for Study Area No. 1, as it relates to the annexation proposals; and to provide newspaper and mail notice to petitioners, landowners within the proposed annexa- tions, and the affected entities at least twenty (20) days before -2- such hearing is provided by law. BE IT FURTHER RESOLVED that nothing hereunder shall be construed: to vest petitioners with rights to require annexation of said property; to bind the City Council to finally approve the petitions or annexations; to vest the petitioners with rights to develop under particular zoning, subdivision or site development ordinances; or to require Salt Lake City to exercise jurisdiction over the area until such time as the decision to annex and extend corporate limits has been made and all annexation formalities and documentation have been completed, including the preparation of the final plat(s) according to the City Engineer's specification, appropriate ordinances, annexation agreements, avigation easements, and documentation verifying the sufficiency of the petitions.
