103 of 1984 - Authorization of Curb and Gutter Extension C2 Y�-y5Z R 84-1 Salt Lake City, Utah /1 October 2, 1984 /&3o�/gay A regular meeting of the City Council of Salt Lake City, Salt Lake County, Utah, was held on Tuesday, October 2, 1984, at the hour of 6:00 p.m. at its regular meeting place of said Council, at which meeting there was present and answering to roll call the following members who constituted a quorum: Ronald J. Whitehead Chairperson Grant Mabey Councilmember Alice Shearer Councilmember Sydney Reed Fonnesbeck Councilmember Edward W. Parker Councilmember Ione M. Davis Councilmember Earl F. Hardwick Councilmember Also present: Albert E. Haines Chief Administrative Officer Roger Cutler City Attorney Kathryn Marshall City Recorder Absent: Thereupon the following proceedings, among others, were duly had and token: In connection with Salt Lake City Curb and Gutter Extension No. 38-763 (the "District"), it was noted that a Cooperative Agreement (the "Agreement") between Utah Depart- ment of Transportation (UDOT) and Salt Lake City had been prepared for right-of-way acquisition. The Agreement has f ` been approved as to form by the office of the City Attorney and the City Engineer has recommended approval of the Agreement. Thereupon, Councilmember Parker introduced the following resolution in writing and moved its adoption: RESOLUTION NO. 103 of 1984 A RESOLUTION authorizing Salt Lake City through its district, Curb and Gutter Extension No. 38-763, to enter into the Cooperative Agreement between Utah Department of Transportation and Salt Lake City for Right-of-Way Acquisition at California Avenue and I-215 Interchange. BE IT RESOLVED by the City Council of Salt Lake City, Salt Lake County, Utah: Section 1. It is hereby found and determined that right-of-way acquisition involves functions which cannot be let out to bid, so that publication of an invitation for bids would have been unnecessary and useless. Section 2. The Agreement with UDOT represents the best method for acquiring needed rights-of-way at the lowest cost to the District and it is in the public interest to enter into the Agreement with UDOT. Section 3. The Agreement is approved and its terms are accepted. The City officers are hereby authorized and directed to execute the Agreement for the District for right-of-way acquisition at California Avenue and I-215 Interchange. -2- The resolution was seconded by Councilmember Mabey, and was adopted by vote of the City Council as follows: AYE: Ronald J. WITH OPEN MEETING LAW COUNTY OF SALT LAKE ) I, Kathryn Marshall, the duly qualified City Recorder of Salt Lake City, Salt Lake County, Utah, do hereby certify: (a) that in accordance with the requirements of Section 52-4-6(1), Utah Code Annotated (1953), as amended, public notice of the 1984 Annual Meeting Schedule of the City Council of Salt Lake City (the "Council") was given, speci- fying the date, time and place of the regular meetings of the Council scheduled to be held during the year, by causing a Notice of Annual Meeting Schedule for the Council to be posted on December 22, 1983, at the principal office of the Council at the City and County Building, Salt Lake City, Utah; said Notice of Annual Meeting Schedule having continu- ously remained so posted and available for public inspection during regular office hours at the City-County Building until the date hereof; and causing a copy of the Notice of Annual Meeting Schedule to be provided on December 22, 1983, to at least one newspaper of general circulation within the geographic jurisdiction of Salt Lake City, or to a local media correspondent; (b) that in accordance with the requirements of Section 52-4-6(2), Utah Code Annotated (1953), as amended, public notice of the regular meeting of the Council on October 2, 1984, was given by specifying in a Notice of Regular Meeting the agenda, date, time and place of the -6- October 2, 1984 Council Meeting and by causing the Notice of Regular Meeting to be posted at the principal office of the Council at the City and County Building in Salt Lake City, Utah, on the 28th day of September, 1984, a time and date not less than 24 hours prior to the date and time of the October 2, 1984 regular meeting; said Notice of Regular Meeting having continuously remained so posted and available for public inspection during the regular office hours at the City-County Building until the date and time of the October 2, 1984 regular Council meeting; and causing a copy of the Notice of Regular Meeting to be provided on September 28, 1984 to at least one newspaper of general circulation within the geographic jurisdiction of Salt Lake City, or to a local media correspondent.
