107 of 1981 - Multi-Family Loans-to-Lenders Program Resolution No. 107 By Report 105 of 1981 CITY COUNCIL DECLARING THAT THERE IS A NEED FOR THE HOUSING AUTHORITY OF THE COUNTY OF SALT LAKE TO EXERCISE ITS POWERS •1ITHING THE MUNICIPALITY BY UNDERTAKING THERIN A MULTI-FAMILY LOANS- TO-LENDERS PROGRAM AND AUTHOR- IZING THE EXERCISE OF SUCH POWERS BY SAID AUTHORITY. Salt Lake City, Utah November 10, 1981 The City Council ("Governing Body") of Salt Lake City, Salt Lake County, Utah ("Municipality"), met in regular public session at its regular meeting place in Salt Lake City, Utah, at 5:00 o'clock P.M. on the loth day of November, 1981, with the following members present: Palmer DePaulis Chairman Edward Parker Vice Chairman Ronald Whitehead Council Member Grant Mabey Council Member Sydney Fonnesbeck Council Member Alice Shearer Council Member Ione Davis Council Member Absent: There was also present Kathryn Marshall, City Recorder ("Recorder") . After the meeting had been duly called to order and the minutes of the preceeding meeting read and approved, the Recorder presented to the Governing Body an affidavit evidencing the giving of not less than twenty-four (24) hours public notice of the agenda, date, time and place of the November 10, 1981, meeting ("Meeting") in compliance with the requirements of Section 52-4-6(2), Utah Code Annotated, 1953, as amended, by (1) posting written notice of the Meeting at the principal office of the Board and (2) providing notice to at least one newspaper of general circulation within the geographic jurisdiction of the Municipality, or to a local media correspondent. The affidavit was ordered recorded in the minutes of the Meeting and is as follows: 1 STATE OF UTAH ) COUNTY OF SALT LAKE) I, the undersigned, the duly qualfied and acting Recorder of the Governing Body do hereby certify, according to the records of the Governing Body in my official possession, and upon my own knowledge and belief, that in accordance with the requirements of Section 52-4-6(2), Utah Code annotated, 1953, as amended, I gave not less than twenty-four (24) hours publice notice of the agenda, date time and place of the Meeting held by the Governing Body of the Municipality by: (a) causing a Notice of Public Meeting to be posted at the principal office of the Governing Body on November 6 , 1981, at least twenty-four (24) hours before the convening of the Meeting, in the form attached hereto as Exhibit A; said Notice of Public Meeting having continuously remained so posted and available for public inspection during the regular office hours of the Governing Body until the convening of the Meeting; and (b) causing a copy of the Notice of Public Meeting in the form attached hereto as Exhibit A to be provided on November 6 1981, at least twenty-four (24) hours before the convening of the Meeting to publish in a newspaper of the general circulation within the geographic jurisdiction of the Municipality, and to each local media correspondent, newspaper, radio station or television station which has requested notification of meetings of the Governing Body of the Municipality. The resolution is as follows: 4 A RESOLUTION FINDING AND DECLARING THAT THERE IS A NEED FOR THE HOUSING AUTHORITY OF THE COUNTY OF SALT LAKE TO EXERCISE ITS POWERS WITHIN THE MUNICIPALITY BY UNDERTAKING THEREIN A MULTI-FAMILY LOANS-TO-LENDERS PROGRAM; AND AUTHORIZING THE EXERCISE OF SUCH POWERS BY SAID AUTHORITY WHEREAS the Housing Authority of the County of Salt Lake ("Authority") has heretofore determined to adopt and implement a Multi-Family Loans-to-Lenders Program ("Program") in Salt Lake County, Utah ("County") , pursuant to which the County Authority will make loans to lending institutions to enable such lending institutions to make mortgage loans to provide financing for multi-family residential rental projects located in the County to be occupied, in accordance with the applicable provisions of law, by persons or families who cannot afford to pay the amounts at which private enterprise unaided by appropriate assistance is providing a substantial supply of decent, safe and sanitary housing; and WHEREAS the Authority will issue its Loans-to-Lenders Housing Revenue Bonds, Series 1981 ("Bonds"), in order to obtain moneys to carry out the Program; and WHEREAS the Governing Body of the Municipality recognizes and finds that there is a need for the Authority to carry out the Program within the boundaries of the Municipality; and WHEREAS the Governing Body of the Municipality wishes to cooperate with the Authority and permit the Authority to make bond proceeds available within the Municipality in accordance with the terms of the Program. NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED by the Governing Body of the Municipality as follows: Section 1 . That the Salt Lake City Council finds and declares that there is a need for the Authority to carry out the Program within the boundaries of the Municipality. Section 2. That the Governing Body of the Municipality in cooperation with the Authority authorizes the Authority to act with respect to the Program and the issuance of the Bonds and to make bond proceeds available within the Municipality in accordance with the terms of the Program. 5 Section 3. That this resolution shall become effective immediately upon its adoption. Passed and approved November 10, 1981 .
