Whitehead Councilmember Sydney Reed Fonnesbeck Councilmember Palmer A. DePaulis Councilmember Alice Shearer Councilmember Ione M. Davis Councilmember Edward W. Parker Councilmember Also present: Ted L. Wilson Mayor Albert E. Haines Director of Finance and Administrative Services Roger Cutler Kathryn Marshall Absent: City Attorney City Recorder Thereupon the following proceedings, among others, were duly had and taken: At the City Council meeting on January 18, 1983, at which a protest hearing was held for Salt Lake City, Utah Curb & Gutter Extension No. 38-681 (the "District"), the City Engineer was asked to tabulate protests and report to the Council. Attached as Exhibit "A" is the tabulation by the City Engineer of written protests submitted in connection with this District for owners of property situated on streets within the District. Thereupon, Councilmember Mabey introduced a resolution to delete certain areas and improvements of the District as described in the Notice of Intention and to create the Salt Lake'City, Utah Curb and Gutter Extension No. 38-681 as amended hereby and moved its adoption: Councilmember Parker seconded the motion to adopt said Resolution. The Resolution was thereupon put to a vote and unanimously adopted on the following recorded vote: AYE: NAY: Grant Mabey Ronald J. Whitehead Sydney Reed Fonnesbeck Palmer A. Parker None The resolution reads as follows: I -2- RESOLUTION NO. 13 OF 1983 A RESOLUTION TO CREATE SALT LAKE CITY, UTAH CURB AND GUTTER EXTENSION NO. 38-681 AND TO AUTHORIZE CONSTRUC- TION OF IMPROVEMENTS AS SET FORTH IN THE NOTICE OF INTENTION WHICH IS AMENDED BY DELETING CERTAIN AREAS AND IMPROVEMENTS AND TO CREATE THE CURB AND GUTTER EXTENSION. BE IT RESOLVED by the City Council of Salt Lake City, Salt Lake County, Utah: Section 1. It will be in the best interest of said Municipality to construct the improvements identified and described in the Notice of Intention as modified by the deletions in Exhibit "B", for the Salt Lake City, Utah, Curb and Gutter Extension No. 38-681. Section 2. The City Council has heretofore considered each and every protest filed and has heard each and every person who wished to be heard in protest against the creation of the District or the construction of any of the improvements therein or on any other matter pertinent to said District. The protests have been referred to the Engineering Department which tabulated them and recommended deletions from the District as set out in Exhibit "B". Section 3. Improvements proposed and described in the Notice of Intention to create said Curb and Gutter Extension No. 38-681 are hereby authorized, as amended, and Salt Lake City, Utah Curb and Gutter Extension No. 38-681 is hereby created. Section 4. The City Engineer is hereby instructed to prepare a notice which calls for bids for the construction -3- of improvements contemplated to be made in Curb and Gutter Extension No. 38-681, and the City Recorder is hereby instructed to publish the Notice to Contractors calling for bids at least one time in the Deseret News, a newspaper of general circulation in Salt Lake City, at least fifteen (15) days before the date specified in the notice for the receipt of bids. Section 5. Construction contracts financed in part by funds which have not yet received budget approval shall be contingent on and subject to obtaining such approval. ADOPTED AND APPROVED this 15th day of February, 1983. The written notice contained the agenda, date, time and place of the regular meeting. I further certify that Notice of Regular Meeting was provided to a local news media correspondent, or to a newspaper of general circulation within the geographic jurisdiction of the City at least twenty-four (24) hours prior to said meeting.
