Proposed Resolution - 6/23/2022RESOLUTION ________ OF 2022 Authorizing approval of Addendum No. 6 and Amendment No. 1 to Addendum No. 3 to an Interlocal Cooperation Agreement between Salt Lake City Corporation and Utah Transit Authority providing for transfer and credit of City funds for implementation of the Transit Master Plan. WHEREAS, Utah Code Title 11, Chapter 13, the Interlocal Cooperation Act, allows public entities to enter into cooperative agreements to provide joint undertakings and services; and WHEREAS, on February 19, 2019, Salt Lake City Council authorized the City to enter into an Interlocal Cooperation Agreement between Salt Lake City Corporation (“City”) and Utah Transit Authority (the “Interlocal Agreement”) providing for transfer of City funds for implementation of the Transit Master Plan; and WHEREAS, the Interlocal Agreement contemplated that the parties would enter into an annual addendum to provide funding for the frequent transit network routes and other transit improvements; and WHEREAS, the City previously entered into Addendum No. 3, as authorized by the Salt Lake City Council in January 2021, to extend UTA service along certain routes; and WHEREAS, Addendum No. 3 now requires amending to reflect funding credits owed to the City due to reduced UTA service levels during the term of Addendum No. 3; and WHEREAS, the City now seeks to enter into a sixth addendum to the Interlocal Agreement to provide for the transfer of City funds for the fourth year of transit services, including the addition of Route 1 and the continuation of Routes 2, 9, and 21, pursuant to the Interlocal Agreement; and WHEREAS, a draft amendment and a draft addendum have been prepared to accomplish said purposes. THEREFORE, BE IT RESOLVED, by the City Council of Salt Lake City, Utah as follows: 1. It does hereby approve the execution and delivery of the following: a. Amendment No. 1 to Addendum No. 3 to the Interlocal Agreement between Salt Lake City Corporation and Utah Transit Authority, providing for the discounting of City- sponsored transit service reflective of actual costs. b. Addendum No. 6 to the Interlocal Agreement between Salt Lake City Corporation and Utah Transit Authority providing for the transfer of City funds for the fourth year of City-sponsored service, including the addition of Route 1 and the continuation of Routes 2, 9, and 21, pursuant to the Interlocal Agreement between Salt Lake City Corporation and Utah Transit Authority providing for the transfer of City funds for implementation of the Transit Master Plan. 2. Erin Mendenhall, Mayor of Salt Lake City, Utah or her designee is hereby authorized to approve, execute, and deliver said agreement on behalf of Salt Lake City Corporation, in substantially the same form as now before the City Council and attached hereto, subject to such minor changes that do not materially affect the rights and obligations of the City thereunder and as shall be approved by the Mayor, her execution thereof to constitute conclusive evidence of such approval.
