SALT LAKE CITY ORDINANCE

(Placement of Small Wireless Facilities in the Public Way)
WHEREAS, pursuant to Utah Code Chapter 54-21 and Salt Lake City (“City”) Code
Chapter 14.56, a wireless provider may install wireless facilities in the City’s public way. Terms
used herein have the meanings given them in City Code § 14.56.020.
WHEREAS, pursuant to Utah Code § 54-21-103, the City may, among other things, adopt
design standards for the installation and construction of small wireless facilities or utility poles in
the public way that are reasonable and nondiscriminatory and include additional installation and
construction details that do not conflict with the Utah Code.
WHEREAS, the Salt Lake City Council desires to provide policy direction on the design
standards for the installation and construction of small wireless facilities and utility poles in the
City’s public way to improve the aesthetics of the public way, minimize disruption to private and
public property, avoid duplication of infrastructure, preserve the character of historic districts,
encourage coordination between utility providers, and better integrate new technology into
existing land use patterns.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Salt Lake City, Utah, as
follows:
Section 1. DESIGN STANDARDS. The City desires to minimize the impact of the
installation of small wireless facilities or utility poles (“Facilities”) on the aesthetics of the City’s
public way. Any design standards adopted by the City related to installation of Facilities in the
public way will include the following, to the extent they comply with applicable law and are
technologically feasible.
(a) A small wireless Facility will be installed on an existing or replacement utility pole
when one is available rather than installed as a new freestanding pole (as described in the design
standards) in the public way.
(b) The aesthetics of any Facility will blend into the surroundings to the extent possible,
including matching the color, height, and fluting of existing surrounding poles.
(c) Installations in residential neighborhoods will be minimized by requiring new
Facility locations to prioritize locations on collector streets rather than local streets, and if an
installation is permitted on a local street, it will be located at the intersection of property lines and
not located in the public way behind the sidewalk (where a sidewalk exists).
(d) Facilities will be installed in a public alley on an existing utility pole when available
rather than on the street and adjacent public way.
Section 3. This Ordinance shall take effect immediately upon publication.
