Proposed Ordinance - 6/13/2023 1 SALT LAKE CITY ORDINANCE No. 37 of 2023 (Past Due Account Receivable Fees) An ordinance amending section 3.16.040 of the Salt Lake City Code and incorporating references to the Salt Lake City Consolidated Fee Schedule. WHEREAS, on May 17, 2011 the City Council adopted Ordinances 2011-23, 2011-24 and 2011-25 to authorize and create the Salt Lake City Consolidated Fee Schedule; and WHEREAS, the Salt Lake City Consolidated Fee Schedule has since been amended from time to time; and WHEREAS, the City Council of Salt Lake City desires to consolidate information related to Salt Lake City (“City”) fees to facilitate the public’s ability to locate pertinent and current information regarding those fees. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That section 3.16.040 of the Salt Lake City Code is hereby amended to read as follows: 3.16.040: PAST DUE ACCOUNTS RECEIVABLE FEE: A. If payment for any debt owed to the city that goes into the city's general fund is not received within thirty (30) days of the date such payment is due, then a past due accounts receivable fee in the amount set forth on the Salt Lake City consolidated fee schedule will be assessed to the party responsible for paying the debt. B. In addition, for each subsequent calendar month in which a payment is late, compound interest equal to five percent (5%) per month shall accrue on the total amount owed to the city. B. The past due accounts receivable fee and the interest provisions set forth in subsections A and B of this section shall not apply in any instance where such fees and interest provisions: 1. Conflict with federal, state or local law; or 2 2. Conflict with a binding contract between the city and the entity or individual required to make payments to the city SECTION 2. That this ordinance shall become effective immediately upon publication.
