MOTION 1 (adopt with development agreement)
I move that the Council adopt the ordinance with a condition that the petitioner enter a development agreement
with the City that includes the following requirements:
•A minimum of 60% of the ground floor street-facing space shall be occupied by retail goods
establishments, retail service establishments, public service portions of businesses, restaurants,
taverns/brewpubs, bar establishments, art galleries, theaters or performing art facilities and/or other
uses intended to attract visitors to the property. The remaining required space would be used for tenant
amenities other than parking (e.g., leasing office, mail room, gym, etc.).
•A minimum of 10% of the dwelling units shall be designated for a minimum of fifteen years to be leased
exclusively to individuals and families earning up to 80% of area median income (AMI).

I move that the Council reject the ordinance.
