HomeMy WebLinkAboutLegislative Version Ordinance - 11/29/2023LEGISLATIVE DRAFT 1 SALT LAKE CITY ORDINANCE 2 No. of 2023 3 4 (An ordinance amending Section 2.14 of the Salt Lake City Code, Airport Board, and Subsection 5 2.07.020, City Boards and Commissions Named.) 6 WHEREAS, Section 2.14 of the Salt Lake City Code, creating the Airport Board, 7 requires amendment to align with state law; and 8 WHEREAS, the Salt Lake City Council has reviewed the amendments and determined 9 that adopting this ordinance is in the City's best interests. 10 NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah that: 11 SECTION 1. Amending the Text of Salt Lake City Code Section 2.14. Section 2.14 of 12 the Salt Lake City Code, regarding the Airport Board, is hereby amended as follows: 13 CHAPTER 2.14 14 AIRPORT ADVISORY BOARD 15 16 2.14.010: General Provisions 17 2.14.020: Definitions 18 2.14.030: Creation Of Board 19 2.14.040: Eligibility For Membership 20 2.14.050: Term; Expiration 21 2.14.060: Powers And Duties 22 23 2.14.010: GENERAL PROVISIONS: The provisions of chapter 2.07 of this title shall apply to 24 the airport advisory board except as otherwise set forth in this chapter. 25 26 2.14.020: DEFINITIONS: 27 In this chapter, the following definitions apply: 28 AIRPORT: All property owned or operated by the city 29 through its department of airports, including the Salt Lake City International Airport, South 30 Valley Regional Airport, Tooele Valley Airport, and any other airport owned or operated by the 31 city. 32 BOARD: The city airport advisory board. LEGISLATIVE DRAFT 33 BOARD MEMBER: A person appointed by the mayor, with the advice and consent of the 34 council, who is a duly qualified voting member of the board. 35 CITY: Salt Lake City, a municipal corporation of the state. 36 COUNCIL: The city council of the City. 37 EXECUTIVE DIRECTOR OF AIRPORTS: The city's executive director of its department of 38 airports. 39 EX OFFICIO MEMBER: A duly qualified and nonvoting member of the board. 40 MAYOR: The duly elected or appointed, and qualified mayor of the city. 41 POLITICAL SUBDIVISION: A county or a municipality in the state. 42 POLITICAL SUBDIVISION REPRESENTATIVE: A voting board member, appointed by a 43 qualifying political subdivision. , with the a&iee and consent of the eetmeil. A 44 politieal s4division representative must, at the fifne of appoin4men4, be an eleeted offieial of 45 46 QUALIFYING POLITICAL SUBDIVISION: A city or town in which an extraterritorial 47 airport owned and operated by the city is located or, if the airport is not located in a city or town, 48 the county in which the extraterritorial airport is located. 49 50 2.14.030: CREATION OF BOARD: 51 " 52 A. There is created an airport advisory board. The advisory board shall consist of 53 eleven (11) appointed voting board members, with the following composition 54 and limitations: no more than two (2) throe «) of whom Y,, reside outside the b,,,,, dar-i � 55 eke C4t�-, 56 1. One appointed political subdivision representative from each qualifyingpolitical 57 subdivision, each of whom shall be included in the total number of appointed board 58 members. The political subdivision representatives shall be anointed: 59 a. in accordance with an ordinance or policy in place in each qualifying 60 political subdivision for appointin individuals to a board. if anv: or 61 b. if no ordinance or policy described in subsection (A)(1)(a) exists, b. the 62 chief executive officer of the qualifying political subdivision, with advice 63 and consent from the leLyislative bodv of the aualifvina political subdivision. 64 2. Not counting the political subdivision representatives, no more than two (2) board 65 members may reside outside the boundaries of Salt Lake City; 2 LEGISLATIVE DRAFT 66 3. At least one board member must have experience in commercial or industrial 67 construction projects with a budget of at least $10,000,000. 68 4. Not less than twenty one (21) years of age; 84 B. A resident of the state; and 85 C. A board member may not serve more than two 89 (2) four-year terms. 90 2.14.060: POWERS AND DUTIES: 91 The board shall have the following powers and duties: 92 A. The power to determine and establish such rules and regulations for the conduct of the 93 board as the board members, and form committees or subcommittees as the board shall deem 94 advisable. Such rules and regulations shall not be in conflict with this chapter or other applicable 95 city, state or federal law; 96 B.
