035 of 1988 - Amending Ordinance No 34 of 1988 Determining the Tax Levy Upon Real & Personal Property 0 88-1 0 88-21 SALT LAKE CITY ORDINANCE No. 35 of 1988 (Amending Salt Lake City Ordinance No. 34 of 1988 determining the rate of tax levy and levying taxes upon all real and personal property within Salt Lake City, Utah made taxable by law for the fiscal year commencing July 1, 1988 and ending June 30, 1989 ) AN ORDINANCE AMENDING SALT LAKE CITY ORDINANCE NO. 34 OF 1988 DETERMINING THE RATE OF TAX LEVY AND LEVYING TAXES UPON ALL REAL AND PERSONAL PROPERTY WITHIN SALT LAKE CITY, UTAH MADE TAXABLE BY LAW FOR THE FISCAL YEAR COMMENCING JULY 1, 1988 AND ENDING JUNE 30, 1989. Be it ordained by the City Council of Salt Lake City, Utah: Salt Lake City Ordinance No. 34 of 1988 be, and is hereby amended as follows: SECTION 1. Chapter 2, Title 59 Utah Code Annotated ( 1953 as amended), states that before June 22nd of each year the governing body of each City, shall, by ordinance or resolution, set the real and personal property tax levy for various municipal purposes. Chapter 2, Title 59, Utah Code Annotated ( 1953 as amended) provides for certain notice and hearing requirements if the proposed tax rate exceeds the certified tax rate. It is the intent of Salt Lake City Corporation (hereinafter the "City" ) to comply with the mandate of the Utah Legislature, but reserve in itself the power to amend the tax rates set herein to guarantee, after final appraisal figures have been determined, that it does not exceed the amount required for its governmental operations and taxing authority granted by the Legislature. SECTION 2. For purposes of defraying the necessary and proper expenses of the City to maintain the government thereof and; for operating and maintaining its libraries and reading rooms, the City Council hereby levies upon all real and personal property within Salt Lake City, Utah made taxable by law in the year 1988, for the fiscal year of Salt Lake City ending June 30, 1989, a tax of .005255 percent on each dollar of taxable evaluation of said property, apportioned as follows: (a) 0� 4383 percent shall be credited as revenue in the general fund; (b) .000872 percent shall be credited as revenue in the special library fund. Said tax levy shall be subject to Mayor approval and City Council reconsideration pursuant to Section 1214, Chapter 3, Title 10, Utah Code Annotated ( 1953 as amended) . SECTION 3. The proposed tax levy exceeds the certified tax by .000080 percentage points. Pursuant to Chapter 2, Title 59, Utah Code Annotated (1953 as amended) , the City shall notify the Auditor of Salt Lake County, Utah of (a) its intent to exceed the rate, and (b) the amount by which it proposes to exceed the rate. -2- SECTION 4. Pursuant to Chapter 2, Title 59, Utah Code Annotated ( 1953 as amended) , the City Council shall hold a public hearing on August 4, 1988 at 5:00 o'clock p.m. in the City Council Chambers, City Hall, 324 South State, Salt Lake City, Utah, for the purpose of hearing comments regarding any proposed increase and to explain the reasons for the proposed increase. SECTION 5. Pursuant to Chapter 2, Title 59, Utah Code Annotated ( 1953 as amended) , the City shall advertise its intent to exceed the certified tax rate in a newspaper of general circulation in Salt Lake County, Utah. The advertisement shall be run once each week for the two weeks preceding the public hearing on August 4, 1988. The advertisement shall state that the City Council will meet on August 4, 1988 at 5:00 o'clock p.m. in the City Council Chambers, City Hall, 324 South State Street, Salt Lake City, Utah for the purpose of hearing comments regarding any proposed increase and to explain the reasons for the proposed increase. SECTION 6. The tax levy hereinabove determined and levied shall be certified by the City Recorder to the Auditor of Salt Lake County, State of Utah before the 22nd day of June 1988, pursuant to the provisions of Chapter 2, Title 59, Utah Code Annotated ( 1953 as amended) . SECTION 7. The City hereby expressly reserves the power and right to amend any property tax levy made herein as it may deem just, proper and appropriate under the law. -3- SECTION 8. This Ordinance shall take effect on July 1, 1988. Passed by the City Council of Salt Lake City, Utah, this 13th day of June 1988.
