019 of 1997 - AN ORDINANCE VACATING AN ALLEY LOCATED BETWEEN 1200Affecting Sidwell Numbers: 15-11-153-002 15-11-153-003 15-11-153-007 15-11-153-008 SALT LAKE CITY ORDINANCE No. 19 OF 1997 (Vacating an alley located between 1200 West and Emery Street and South of Indiana Avenue pursuant to Petition No. 400-96-77) RECEIVED JUN 1 6 199/ CITY RECORDER AN ORDINANCE VACATING AN ALLEY LOCATED BETWEEN 1200 WEST AND EMERY STREET AND SOUTH OF INDIANA AVENUE, PURSUANT TO PETITION NO. 400-96-77. WHEREAS, the City Council of Salt Lake City, Utah finds after public hearing that the City's interest in the alley described below is not necessary for use by the public as an alley and that vacation of said alley will not be adverse to the general public's interest. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That the alley located between 1200 West and Emery Street and South of Indiana Avenue, which is the subject of Petition No. 400-96-77, and which is more particularly described below, be, and the same hereby is, vacated and declared no longer to be needed or available for use as an alley. Commencing at the southwest corner of Lot 12, of the Burlington Second Addition, a subdivision located in the northwest quarter of Section 11, Township 1 South, Range 1 West, Salt Lake Base & Meridian; thence east 148 feet to a point on the south boundary line of Lot 7 of said subdivision; thence south 11 feet to the northeast corner of Lot 50 of said subdivision; thence west 148 feet to the northwest corner of said lot; thence north 11 feet to the point of beginning. SECTION 2. RESERVATIONS AND DISCLAIMERS. The above vacation is expressly made SUBJECT TO all City water, sewer and storm sewer rights -of -way and easements, and rights -of - way and easements of all public utilities of any and every kind now located on, under or over the confines of the property hereby vacated, and also SUBJECT TO the rights of entry upon said vacated property by the City and all public utilities for the purpose of maintaining, altering, repairing, removing or rerouting said facilities. Said vacation is also SUBJECT TO any existing rights -of -way or easements of private third parties. SECTION 3. TRANSFER OF TITLE. Title to the property is hereby transferred from the City to all abutting property owners on a pro rata basis. SECTION 4. EFFECTIVE DATE.
